It appears for the past several months a HUGE amount of I-751's are being rejected as "the supporting evidence does not sufficiently establish that you and your spouse entered the marriage in good faith and continue to share a good life together".

I (Larry and Ella) submitted the deed (fully paid for) for our house in our names, sent the 2011 and 2012 12 tax forms, a joint check account for several months, two affidavits (notarized) Joint health insurance cards, joint auto club cards, deed in both names, insurance policy showing beneficiary credit card statements, etc, and a USB of pictures. My wife has over a thousand pictures with date and GPS coordinates in some cases,

USCIS stated: The evidence does not establish, in sufficient detail, JOINT OWNERSHIP of assets, Joint responsibility for liabilities, and/or an active co-mingling of finances "FOR THE DURATION" of the marriage. Supporting documentation must cover as much of the marital period as possible, and must also indicate joint financial responsibility and joint residency for that same period.

Larry: The key words appears to be for the joint and for the duration of the marriage.

So leases have to be rewritten? Cars that are already owned and paid for and you get a discount for being the original owner need to be re-titled, phone service, cable service, electric statements, and if you have any loans, must be in both names?

Well, holy #######.

I had to send the entire bank statements for every month showing deposits or withdrawals on every account we had. Gee USCIS, do you really need to know I like turkey sandwiches at the grocery store?

What is so bad is that we both are almost joined at the hip we are so close to each other after 3 & 1/2 years of marriage and cannot possibly think of a time when we would wish to change that. She has her own car (hybrid paid for). We even have electric mopeds that we ride around. Her facebook page gets updates several times a week with new pictures. She really like pictures of herself or us, hehehe.

Anyway, If Visa Journey would like, I can scan my letter from USCIS. I did return USCIS asked for several months ago and still no word.

Wow, you guys have more evidence than most, it's troubling for sure. The USCIS officer whom adjudicated your case must have spilled her Starbucks on the way to work that morning and no evidence you can supply will fix that.

They don't accept USBs, so that evidence was just thrown away. I think your evidence was good, except that you only sent a few months of statements. They want to see at least quarterly statements to see that you both use the account. Do they want to know you like turkey sandwiches? Sort of... They don't care what you buy but they want to see that you did buy things. They want to make sure that you don't just have a dummy account with 2 pennies in it as a "joint" account.

No joint credit cards? Any 401K plan or the like from your job?

Hey holy #######

The guide clearly points out that you need to send information that covers the duration of the marriage...many of the RFE's in the last several months are due that reason alone...no big deal...just follow all the instructions whether you like them or not, and I do like turkey sandwiches !!

Well Dr Larry I agree with you. We got an RFE for similar reasons after submitting similar evidence (minus the affidavits) and I was kind of stunned. We then sent a couple of affidavits, 2012 tax return which wasn't yet filed with our initial application, passport stamps for our joint travel etc... and Michel's approval arrived yesterday. We received the RFE on 25 May, sent the reply 31 May and approval came yesterday.

I'm of the mind that photos alone should be proof enough provided date and place can be determined. I see no reason a couples finances have to be intertwined at all. I was married to my ex (also from the Philippines) for 23yrs and the only thing we ever held jointly was a mortgage. I can see insurance policy's, will's etc..., but the rest shouldn't be required in any way.

While none of us could show any proof, I tend to agree that the folks in Vermont seem to be pretty agressive on this and I think it's wrong.

Yes, all bills and bank statements from every month for the past 2 years are a must. While most of what you initially submitted show much that is joint (which is good, as that is a must as well), but not for the duration of 2 years.

  • 3 weeks later...

The latest update, after I sent in all the statements from 3 years, irs forms (again), Title of home (again), more photos, etc we got an interview date where we were told to bring, mortgage, bank statements, irs tax statements (all again).

I went to the irs website and had transcripts sent (took about 10 days), I reprinted all the bank statements again, etc. I also had printed 466 photos.

Agent asked us if we had anything new that she did not already have. She looked and had all that the paper asked for again, we also gave her the transcripts and the 466 pictures.

Now get this.... Not all pictures had both of us in the same picture. But we had each other in the same shot, I would take her, she would take mine. All date stamped. She said well who took these pictures? After giving her a stunned look, I said, well, I took my wife's picture and then she took mine. all the way back over 3 years. She gave us back the photos and said, ok I am going to approve the 10 year extension. Here are your photos.

Total time to VERBAL approval - 51 weeks.

As a side note in 5 more days she will apply for US citizenship.

Funny how USCIS doesn't obtain information from the NSA, or they do have them but they want to see if you have the matching set?

I don't understand why the evidences you have submitted aren't good enough. If I'm the IO with the most severe common sense deficiency disorder even I'd approve it.

It's been almost a year since my ordeal with the I751 (which IS STILL PENDING ACCORDING TO USCIS) and I can tell you I've read so many posts I can't even come to a conclusion how the USCIS approves the applications. Sometimes you'll have people submitted less than minimum stuff with no RFE and approval in a month or two, sometimes you'll end up with applicants like me whose I751 got RFE-ed, delayed forever while I already took my OATH CEREMONY & became a citizen almost a year ago.

Either way, USCIS is ran by bunch of mentally disturbed, picky, paranoid & often judgemental against certain applicants, untrained monkeys who gets paid in I.O.Us.

That's because they factor the evidence submitted with other information about the couple, like how many red flags they have and some understanding about their situation.

The directions clearly state that they want evidence spanning the length of the marriage.

Of course, then again if they don't have a guideline to look up to, or even alternating to whomever is working on the case's liking then it's nothing but a wild guess to how the case might end up.

I've submitted a phone book-and-a-half sized evidences from the initial submittal to RFE response, spanning between we first started dating to the very day the bank statement is available for print. They didn't even acknowledged me they have received it or any reactions will be taken. After a SR, the congressman & my N-400 application (which is approved), my I751 is STILL UNTOUCHED.

What can I say.
