Did you meet in person in last 2 years before filling? - oh, I think this is the technical side...he filed it before he comes here in to meet me. but we thought that since they would asked for RFE, that would be ok already.

That alone would be a reason for denial. I don't think it matters, at this point, if there is anything else missing. Do not appeal, as they were correct to deny you.

Refile and file correctly. Check the guides on this site. That will be your biggest help.

maybe so...we will see what would be our next move..maybe refile again and wait for 6 months more..right now, we are planning for him to come here again while we are in the process how to move forward. Is there any gap period required before we can refile again for another petition?

I'm sure someone will chime in about when you can refile.

I think it's good that he will visit you again, and it will be one year soon.

When you get your denial letter, we will be able to help you see if there is anything else that needs to be addressed.

You were denied because you failed to meet her before filing. You cannot file before meeting. It has to be the other way around, or they will deny it. The RFE asked for evidence of a meetup before the date of the filing. And since you obviously did not meet before the date of the filing, you didn't submit this evidence. Therefore, you were denied.

File again now that you have this meetup behind you and the evidence of it. You can do so immediately.

It means you will get an NOA2 or RFE within the next few days.

I hope i did answer all your questions.

So you did not meet in person before he filed? I think you have to re-file, no appeal

How much older is he than you? - I am 39 and he is 57

Do your parents approve of him?- yes, he has been here for 2x already and meet the entire fam. he also proposed infront of the whole fam.

Do you have any other family in america?- no, I don't have any.

Has he petitioned anyone else? - no, he hasn't. this is his first time.

Have you had a petition filed for you by another man? - this is my first time too

Have you been to america?- not yet...no reason to get there for me until I met him.

Did you overstay?

How long have you known each other?- turning 1 year this July 8.

Hiw many times did he visit you?- 2x

How many days have you spent together?- he was here 3 weeks on his first visit and 8 days on his second visit.

ok - so the petition was denied because you two had not met prior to filing.

IMO, an appeal would be useless.

Since he's seen you already within a 2 year span, is best he prep a new casefile with new evidence and lots of new stuff this weekend,

and file it monday.

He doesn't have to wait for the denial letter, at all. Pay attention to the block about 'have you filed for someone before' in the I-129F and fill it out properly.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

if u didnt send a letter of intent to marry indicating within 90 days of entering US definately they can not approve you. affidavit of support is for interview stage not there. i think you are not telling everything and its hard for us VJ members to help you. all the same good luck to you
