Appealing a properly-denied application would be pointless. Just because it worked in your circumstance does not mean everyone should do it.

Once the OP has the written notice then better advice can be given.

We were denied also, once you get your denial letter you should be able to appeal. Which is what we did and we were then approved. So you shouldn't have to start over you should just be able to appeal and pay the fee required.


what is the reason of your denial and what kind of appeal did you do? so we still have the chance to appeal our case right?

Not if USCIS were correct to deny your application, appealing would just be a good way to waste a year.

Again, it will depend specifically on the reasons they give you in the written denial.

We just had a talked just now and that really breaks our heart but I know this would make our love stronger...and we can face the challenge...We just have to hold on and keep the faith to our dear God....thank you all for replying and we will keep you posted.

Your K-1 application was not denied, your I-129F petition was. You have not applied for any visa yet.

An affidavit of support is not required for the i-129F petition so I am not sure why that would have been requested in an RFE.You keep skipping over all the questions from everyone in regards to what the RFE actually stated and what you actually sent back to them. That knowledge is important information that anyone trying to seriously help you would need to know. You should really answer those questions.

Not a problem. To better assist you, please type here word for word the body of the RFE letter you got, the date of this RFE letter, list exactly what you sent in response (be as specific as you can), and the date you sent it in.

I'm sure this has been a traumatic day for them. It sounds like the beneficiary is posting here. She may not have a firm grasp of the English language. Most likely the beneficiary does not have the original RFE. Further they do not have the denial letter. Lets give them a minute to talk and regroup.

I'm sure they understand we need all available information to give solid advice.

sorry for not answering all your questions...I am not on my computer all the time.Right now, we are still waiting for the notice, so I can't really tell you the reason of the denial. As far as my fiance is concerned, he did send all the documents needed as per RFE. So , we too, don't know the real reason until we get the notice from USCIS. but as soon as we get it, we will let you know so we can get advise then we will move from them.

I hope i did answer all your questions.

How much older is he than you? - I am 39 and he is 57
Did you meet in person in last 2 years before filling? - oh, I think this is the technical side...he filed it before he comes here in to meet me. but we thought that since they would asked for RFE, that would be ok already.
Do your parents approve of him?- yes, he has been here for 2x already and meet the entire fam. he also proposed infront of the whole fam.
Do you have any other family in america?- no, I don't have any.
Has he petitioned anyone else? - no, he hasn't. this is his first time.
Have you had a petition filed for you by another man? - this is my first time too
Have you been to america?- not yet...no reason to get there for me until I met him.
Did you overstay?
How long have you known each other?- turning 1 year this July 8.
Hiw many times did he visit you?- 2x
How many days have you spent together?- he was here 3 weeks on his first visit and 8 days on his second visit.

Thank you for your understanding...yes, I dont have the original RFE but he sent me the list of all the documents needed and we discussed and reviewed them once again before sending. and we dont have yet the denial letter...

but I would like to thank everyone for replying..it made me feel a bit ok to know that we can still something about it or at least refile or make an appeal. I know our next move will all depend on the reason of the denial once we get the notice.

For sure, I will post and will let you know so we can get some advise.
