can somebody help me? when i submitted my petition for my Filipina fiancee at the USCIS California Service center, i forgot to write down our names in the back of the passport pics that were to be enclosed with the form G25A. Will this affect the petition? I submitted it last October 3 and got the notice of action October 6. And if it does affect it, what are the necessary actions should I take to correct it. Im afarid this will make our waiting longer.

Thanks!

If it was a 3/4 view they would not accept it. That was the old standard and now must be a full frontal shot. Basically a standard passport photo.

If the photo is not acceptable they will send you an RFE requesting a new one.

i think that they are very strict with the passport style full frontal pic. I suggest that you send the correct pics to the service center. Mark on the front of the envelope "I-129F additional submission (passport photos)" then also include a letter stating that the size of the pics previously submitted was wrong, and these are the correct ones. Also include a copy of your NOA1

If the picture size is not acceptable, you will get an RFE for new photos. Don't send new ones without being asked for them - this will only complicate and confuse matters since the new unsolicited pics may never catch up with your file.

how long does it normally take for them to send me the RFE? And if they do get the new pic, how long do we have to wait for the NOA?

thanks!

Impossible to know. When they get to that part of the file, if they decide to send an RFE they will email you. Then it will take a few weeks for you to get it and send the pictures back. Then they will update you case and begin to continue processing.

I too was concerned about my photos as they were slightly larger than the dimensions required but I got an NOA1 within a few days and I have to receive a dreaded RFE (knock on all wood in my close proximity) for that or a birth certificate copy. I wouldn't worry about the photos too much, I would guess they would just write the name for you on the back or something.

USCIS requires face forward view not 3/4 view, you must be reading old instructions.

You should have no problems with your photos.

Oh geezzz! Is it best to keep on calling them to follow up my petition? I really want my fiancee to come here and so is our son who keeps on getting sick due to the pollution there in the Philippines. he developed asthma because their neighbors burn their garbage ( a normal practice there) .our son is already an american citizen since I already filed a petition for him to get a consular birth in abroad.

How long do you think will we have to wait until we get the approval of the petition?I filed it last Oct 3, 2006 and got the NOA1 Oct 6, 2006

There's nothing to be gained by calling them to follow up. The people who answer the phone will only repeat back to you when the petition was received - they don't have any other information.

Go by the timelines here for people processing from CSC around your NOA1 date and plan on 60-120 days for petition processing (barring RFEs, etc). From there, timing to the NVC, to the Consulate, for the medical appointment and interview date, and final visa pick up, it all depeneds on how quickly the name checks and interview scheduling goes.

I would expect her to be in your arms stateside in June or July next year at best. You would do well to settle in for a long wait.
