I'm freaking out right now. This is my situation:

Currently I'm in the US on a student visa and just about to leave as I just graduated from college.

My fiancé is American and our wedding is set to a date in May next year. I talked to the american embassy in my country and they said that the waiting time is approximately 1 year!

So basically I won't be able to enter the country in time for my own wedding?!

Usually it takes about 7-8 months apparently, according to their website.

Can someone shine some light on the situation and if there's anything I can do at all.

Oh dear, it is really hard to guess how long would it take to get a visa! That's why it is not suggested to plot a wedding on a specific day/ time! For me it is ok to plan but make sure you have room for adjustments in case... ;)

Try to read more and see other members timeline... you will get an idea somehow...

if you entered the country as a student, and not with the intent to marry, can you get married and apply for AOS instead of leaving?

K1 Journey
20th May 2013: I-129F sent to Dallas (US time)
23rd May 2013: Paperwork tracked and delivered to Dallas (US time)
28th May 2013: NOA1 case sent to Vermont Service Centre (US time)
4th Sept 2013: Update from USCIS-Case has been transferred to a local USCIS office...not sure which one yet
9th Sept 2013: Update from USCIS- file has been transferred and is now being processed at Texas USCIS office
23rd Sept 2013: NOA2- approved!
25th Sept 2013: Case shipped to DOS
9th Oct 2013: Packet 3 arrived via email
9th Oct 2013: Fingerprints done and Police check submitted to AFP (received in mail 30/10/13)
1st Nov 2013: Medical Appointment, (Melb) (results received in mail 15/11/13)

4th Nov 2013: Packet 3 sent to US Consulate, Sydney

5th Nov 2013: Packet 3 delivered to Sydney

8th Nov 2013: Received packet 4

19th Nov 2013: Interview scheduled- APPROVED dancin5hr.gif ...happy birthday for Joe! (visa received in mail 22/11/13)

Total K1 processing time- 6months, 3 days

30th Dec 2013: Entered the USA! POE: Dallas

8th March 2014 MARRIED! (L)

AOS:

7th Oct 2014: After unexpected delays, AOS package finally sent to Chicago

14th Oct 2014: Update received, I-485 accepted on 9th Oct and being processed at the National Benefits Centre

6th Nov 2014: Biometrics appointment scheduled and completed

16th Jan 2015: Letter received stating possible Interview Waiver. Informed there's a 6mth delay on processing

7th Aug 2015: Notice of Intent to deny received. Reasons given- expired Medical and new G-325A needed

11th Aug 2015: New medical completed

14th Aug 2015: Response to RFE sent back to USCIS

23rd Aug 2015: Application to Adjust status approved, Green card has been ordered

3rd Sept 2015: Greencard RECEIVED (yes it is Green!) :no:

Total AOS Processing time- 11 months

I thought of that too and no, arrangements have been made for a wedding date already.

I never expected it to take so long.

Can my fiancé file the I-129F while I'm still in the country on my student visa?

Your fiance can file right now, but you still won't make it for your wedding.

Unfortunately you have made impossible plans, based on misinformation, so something needs to give. You can get married in a court house now and start the AOS paperwork, knowing you can't travel for a few months. Then have your big party next May.

Or you can leave, come for your wedding on the VWP, then leave again and file for a spousal visa. That also takes about a year, so you could move here in 2015.

Or, you can change your wedding date.

Never make any wedding plans until you have your visa in hand. Change the date if you need to. Figure about 10 months for the process.

Hopefully you can reschedule your wedding plans. Even if you make it you will worry about it every day until that visa is in your hand and believe me, this wait is stressful enough! You don't need a timeline to worry about too.

Why don't you just do a small wedding now, courthouse style, adjust status and then still do the planned wedding in may? The wedding would only be symbolical then but you could still keep your plans.

Can't make an AOS because my student visa has expired and I'm on my last few 30-days-to-leave time. So right now I have nothing.

If I change the wedding date and it ends up taking a few months to get the fiancé visa, I'll be a little angry..

Sure you can do an AOS.

But you won't be able to leave before having a GC in your hands.

Are you sure? From what I have heard, you can't adjust a status that is expired (my student visa), but if I would have done it before it expired it would have been ok. Maybe that is incorrect.

That is incorrect. You can still AOS based on marriage to a USC.

You gotta get married to adjust.

And like I wrote earlier, do a small courthouse wedding now if u want and then in May do it as you planned but since u will already be married it will all be symbolic or a renewal of ur vows...

Of course I'd be mad. I'm mad that I have to stress about my wedding in the first place! And leave it up to some immigration people.

It's just hard for me to grasp that applying in July is too late when the wedding is in May.. It's over 10 months. That's not so different from a year.

Keep the dream alive...
