Hello my name is Jacquelyn. My husband and I are currently living in Malaysia ( hubby's home country ). We got my spouse visa with no problem and are in the beginning stages to apply for his spouse visa for the United States.

I sent an email to the US Embassy in Malaysia to ask which form to fill out for the spouse visa for the US, and several more questions that that refused to answer. Why is it so difficult to find information that is needed to get a spouse visa? It was so easy here in Malaysia.

Can we apply for my husbands spouse visa if I am not in the United States? He already holds a B1/B2 visa.

Thank you for any help you can offer, I am sure there will be plenty more questions to come, lol.....

If DCF is available in Malaysia and you've been there long enough to qualify, do that. It's usually faster.

Else, you can do the normal I-130 route.

* I-130/CR-1 visa by Direct Consular Filing in London
3rd May 2013 - Married in London

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

I apologize but I am so ignorant to the abbreviations. What is DCF?

DCF stands for "Direct consular filing" and it's a method by which the petition I-130 for CR-1/IR-1 is filed directly with the US embassy in the country you are residing in abroad. It's not available in all countries, and generally there is a requirement that the petitioner (the USC) have residency in the country for at least 6 months prior to filing.

According to this page, DCF is available: http://www.visajourney.com/consulates/index.php?ctry=Malaysia&cty=Lumpur but the consulate pages on here are often out of date and in this case, it does appear to be inaccurate (I've just corrected the entry) as on the embassy website, they would like you to file via the Chicago lockbox:

welcome to VJ! There are other Malaysians who have successfully gone through the immigrant visa process with no big issues.

First, I suggest you study a guide here.

Second, I suggest you study your portal (click your flag) and study the timelines at your portal.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

If you want your process to go smooth, you might have to spend some time and understand the process.

It is not just you fill one form and you are done.

Ppl on this board can help you with querry or suggest best options but you cannot expect to get ready made answers, if thats what u looking for, you should hire a lawyer.

Most cases consulate would not advice you anything as later in some point they don't want you to come back and say I did everything as you said and still how did I not get the visa.

So most important thing, if you are not going to live in US than applying for spouse visa is waste of money and effort.
