Hi all,

We are wanting to file our I-129F petition but not sure what to do with question 12: "If your fiance(e) is currently in the US (which he is), complete the following..." It then asks for the the I-94 Arrival/Departure number. To our knowledge these numbers are no longer issued at the point of entry, because ESTA is filled out online in the UK. Since he is currently here in the States, how should we fill this out? There is no specific option to state that he is in the country, but does not have the I-94 number. We do NOT want to receive an RFE over the answer.

We greatly appreciate your help!

Huh.

That question isn't relevant. It just happens that your fiance is there while you're completing the form. I hope your fiance is returning home to the UK, since that's the correct thing to do for an I-129f/K1 visa. For pretty much every other person on this website applying for the K1 path, the answer to that Q is N/A.

Maybe you need to explain your situation a little bit more - is your fiance in the US on another kind of visa right now and living there?

Answer in truth. Yes he is here but I-94 number is N/A (ESTA visa used)

I (beneficiary) was in the U.S. when we filed and we wrote in the box something like "travelled on VWP, expires 1st june, leaving 1st april. Please see attached." and then attached a page with the scan of the passport stamp I got at POE. We left the number part blank.

Our petition hasn't been accepted yet so I don't know for sure that we won't get an RFE, but it seems like the logical thing to do.
