Hello everyone!

First of all I would like to thank you all for this amazing community,I've been literally studying all the procedures and wiki from here!its a jungle out there and all I've found here is helping a lot!

A little bit about us: I'm the beneficiary(Italian)and I've met my now husband while in the states on a j-1 visa back in 2009. I've lived there till July 2011 and he moved in Italy with me for a year. Then due to job he moved back to states proposed and on may 31 st we got married in Italy!!!!

Now we are about to start our CR-1 process and it looks scary!even though seeing all the happy endings on vj gave me a good dose of strength!

Here is my first question: i can't find clear answers about this. We are both going to the states in July to visit my husbands family and for our honey moon, and we would like to start the I-130 right away. Is it possible even If I'm there?i have NO intention of staying of adjust status. I will be back in Italy in September with work established. Is it possible or I have to be away in order for him to start filing?

You can file the i-130 while you are in the US, provided you leave before your days on the VWP expire.

Being the wife of a US citizen, you could be subject to more scrutiny at the border, as they might want to make sure you aren't entering the US on the VWP with the intent of adjusting status. Bring with you proof of ties to Italy (work contract, lease, etc) and of course have a return ticket to demonstrate your intention of going back. Good luck.
