Annulment, USCIS and US Embassy

Timeline

My friend's fiance (petitioner) didn't put on the I 129F form and G325A that he is annulled but they got approved by the USCIS. How is that possible? Will they be having problems on the interview because of that?

yes it is possible.. there is NO national data base with annulments, dissolutions and divorces

it was the petitioner's responsibility to ensure that the information was accurate

honestly I do not know what to suggest to you at this point .. there is some misrepresentation on the petition itself, whether or not it was knowingly.

past relationships may or may not be asked about in the interview

Omitting data pertinent to the process is not good.

What did you fiancé answer for Part A question 9 of the I-129F? If he completed the form correctly and USCIS just didn't catch the absence of the annulment documents, then its just an oops... and who knows what the embassy will do with that, just make sure to include it at USEM.

One of the main requirements for the K-1 process is that each party much be free to marry. The instructions for the I-129F are very clean about providing documents showing your are free to marry (divorce decrees or annulments) - 5 (d) of the instructions.

At the embassy they will AGAIN ask for a copy of documents (divorce decree/annulment) from BOTH of you (For the beneficiary the NSO CENOMAR is what is required). Item "L" of the embassy instructions letter.

I would not omit anything for the visa interview!
