Incorrect. George has to prove not only that he was in fear of his life or great bodily harm but that he was in that fear by reasonable standards. It's called an affirmative defense. That's what George is pursuing. And the burden of proof in such defense is on the defendant.

To prove second degree murder, a prosecutor must show that the defendant acted according to a "depraved mind" without regard for human life. Florida state laws permit the prosecution of second degree murder when the killing lacked premeditation or planning, but the defendant acted with enmity toward the victim or the two had an ongoing interaction or relationship. Unlike first degree murder, second degree murder does not necessarily require proof of the defendant's intent to kill.

Does anyone remember that originally the whole "stand your ground" defense was the entire reason GZ shouldn't be even arrested? Now we know that he was not even remotely close to that definition of the law.

If anything, TM was within his right to claim SYG, because he wasn't committing any crime and was being attacked by GZ far from where GZ was originally.

So the head being pounded by TM was justified based on Florida's own SYG law and GZ was the person actually committing a crime. That's a first degree murder charge with special circumstances...GZ is lucky with only getting the 22 year max.

Guilty baby...

Problem 1. TM is dead. The first rule of claiming self defense is to show up in court.

Problem 2. GZ is not likely to agree with your assessment and there is no one to testify otherwise

1. He's not being lynched, he's being tried in a court and the penalty is 22 years max for taking a human life and not hung on the end of a rope..

2. He shot someone, there is usually a penalty for that.

It was dark and raining, so that's expected.

In my mind, if anyone needs to prove anything it's GZ, he's gotta prove he needed to use deadly force...nothing so far proves that...and "stand your ground" is out the window at this point. His meeting TM there was GZ decision, not TM.

If the other testimony is affected by being dark and rainy then as I juror I have reasonable doubt. Three gunshots? There was only one. Reasonable doubt that anything else that person says is accurate.
