Hello,

So the plot thickens. Thank you for your previous responses. I'm trying to assess all our options before making a decision on how to proceed.

So I'm in my last year of Medical and Graduate school. I have no income. Residency will not begin until July 2014 at which time i'll be earning an income. So if i was to do this by myself July 2014 would be the earliest time that I could begin filing for my then husband (Canadian citizen) right?

I'm think about the possibility of starting the process as soon as possible since it seems that there will be at least an 11 month period where he cannot reenter the US (at least not with 100% certainty). If my mother agrees to be a co-sponsor would that suffice? Her income is more than sufficient. Would that allow me to file for him now even though I am currently a student and I do not have an income yet?

The idea of waiting until next summer to begin filing and spending a total of another 2 years apart is disheartening.

Does any one have any experience with this?

Yeah, you can use a co-sponsor (your mother) and file immediately. She won't need to do the proof of income bit until after your petition approval (so in a few months time - if she needs a bit of time to gather documentation or anything). The fact that you don't have income is fine so long as your sponsor has sufficient income for everyone in their household + the person they're sponsoring.

4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)

27th August 2015 - 10 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

26th August 2016 - NOA1
13th September 2016 - Biometrics

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath

Wow, just want I wanted to hear! Ok I'm going to run this option by him and see what he thinks. He's kinda super excited about our current wedding plan for next summer, hes' been 'shouting from the roof top' to friends and family for a while now. But if postponing it will ultimately mean we are together sooner than I'm much more in favor of that route. We'll have to make a decision so though because our first installment of the venue payment is in a few days!

These are the guidelines from the state department that should give you an idea of what a sponsorship is and how to qualify as one. http://travel.state.gov/visa/immigrants/info/info_3183.html

It refers to the I-864 form, which is the one you'd do if you were married (i.e. I-130 then CR-1 visa). If you're going to go for the K1 visa route (which I'm assuming you're not, but just incase), the support form is the I-134, but the requirements are pretty similar, so the guidelines there should still help you out.
