In Illinois, what you have coming into the marriage is yours still in the case of divorce, well at least that is what I think.

I own a small business and would like to protect it from divorce.

We are getting married in 4 weeks. And she lives in another country.



Does anyone know:

1) If I have to display the Value of the business somehow in the prenup? I am not even sure what the value of the business is.

2) Can I do a simple online prenup just listing the business as my only asset? I have nothing else.

3) Does anyone know where I can get some ready-made prenups at?

4) Does anyone have any experience in protecting a business in a prenup?

5) I will finish the prenup, send it down to her and her lawyer, have her and him sign it, along with write a letter saying he represents her and there is no language barrier and they understand everything. They will get it notarized at the US Embassy. She will also record a video saying she is not under any duress or pressure to sign it and understands everything. Should this be enough?

All of the prenups lawyers want to make cost between $2000-$4000 and even though I own a small business, it doesnt have that kind of money. Shouldn't this be simple if I only have one asset being the business and will follow the laws with support and maintenance?

A prenup is not simple. You need a lawyer.

If there is enough assets and value in your business for you to be concern, then $2,000 to $4,000 is cheaper than losing half.

Prenups have a special place in contract law. You can blame or credit Barry Bonds if you live in California.

A DIY prenup is not the way to go. It could easyly be voided for various reasons relating to how the prenup was presented, whether the parties were represented by lawyers, if English is not the first language of the weaker spouse, etc.

The worst case scenario would be for a judge to throw out the agreement because you didn't do it the exact way described by the laws in your state.

My hubby ( US citizen ) don't want to make... but how he had his assets and I have nothing than my personal things, I wanted to do and the only thing I asked was that he would allow me time enough to get everything done and documents needed to go back to my home country and that he would pay my return tickets!

I am not on his retirement plan

Not have rights for his things ( before the marriage )

No right to ask monthly support

We did with the same lawyer that handle our marriage by proxy...and we paid $ 300.00 ( in 2011)

You can put an exclusion for business and company assets... But you need to visit with a family lawyer... You have one chance to get it right and not too much time...

You can put an exclusion for business and company assets... But you need to visit with a family lawyer... You have one chance to get it right and not too much time...

Does anyone know what a clause looks like listing a small business as an asset in a prenup?

Been searching all over and can't find it. I am guessing to just list the name of the business and the address with the value, but I am looking for something more specific to a business- not just like other assets like vehicles, real estate, etc.

Please help!

Good thing you don't live a little further north, prenuptial agreements are not even recognized in Wisconsin. A couple could split up without one trying to rob the other. I sure know about robbing from my ex, was so deep in debt was just about ready to hold a gun to my head. But also had two kids I managed to get full custody of, and was suprised I paid everything off in five years. Didn't have that b!tch around spending the money I earned spending it faster than I could earn it.

With my new wife, after two full years of dating, developed a true trust relationship with her, she also had an ex like mine that was also spending her money faster than she could earn it, but never tried to screw him in her divorce. It was also the kind or relationship, where I couldn't live without her. I had no hestitation about signing that I-864 for her, or even adding her to my home deed. USCIS expects you to do things like this.

She also had a close friend that was just like her that married a first class jerk in Milwaukee, this guy really treated her terribly. She applied for a divorce without a single claim against him and went back to her mom in her home country. Just commented to my wife, if that happened to us, could only thank her for the most wonderful years in my life. Don't feel that is going to happen to us, but you never know.

My suggestion to you is, if you feel you really need a prenuptial agreement, to start looking someplace else. Yes I met plenty of women and this time was able to detect the signs, their only motivation is to rob you to death. My wife also made me believe in soulmates, find a woman like that.
