I would say: https://secure.ssa.gov/poms.nsf/lnx/0300204025

g. An alien who is the spouse or child of a United States citizen whose visa petition has been approved and the alien has a pending application for adjustment of status.

Form I-797 (Notice of Action);

I don't see why it wouldn't work.

We are legal if we come on a K-1, marry and adjust status within the 90 days. And the NOA proves it (if we don't send the AOS, then we are illegal and in overstay)

Anyway, this is probably much easier to just wait for the EAD.

Good luck in your visa journey!

Well, if she gets her EAD and no SSN, she won't be able to work, right?

That can be stressful, probably?

For car insurance, you need the SSN too... They also ask it to open a bank account.

But there must be something to be done, surely. Because we are not illegals between I-94 expiration and GC approval.

OP, have you tried calling the DOS?

She cannot get a DL until the adjustment of status is complete, most state's are now working in synch with Homeland Security and they need to verify status, so the car insurance is not really going to help.

SSN is not required to get a car insurance, they do not need your credit history.

SSN is not even required to open a bank account.

Some adjusting as status is not illegal, as it says "Adjusting the Status" you got to wait until the adjustment is complete.

laws did not used to be this strict but unfortunately some ppl have abused the slack laws so now rest of us are paying for it.

I remember the days when even a tourist could walk into DMV office and get a DL with validity of 6 yr, not possible anymore.

Hey, I had a similar issue last week, I don't know if we would come under the same issue...I applied for my SSN on 9 May - I-94 epired 9 June...the office messed up by not clearing the second pin code, and was told they couldn't do anything and I had to wait for AOS. HOWEVER - I took receipts of my application for AOS, greencard and advanced parole...the cleric took my alien number and because the SSN was applied for before the I-94 expired my SSN was granted!! Not trying to fill you full of false hope but this was MY experience, so it may be worth going to your local SSN to speak to someone face to face with your confirmation letter of applying for SSN and Homeland Security receipts?? Good Luck!!

My point exactly.

She can get a DL before AOS. She can get a DL without EAD. It depends on the state. I have one that is valid for 6 months since the day I took the knowledge test. I brought the NOA from the AOS. The first person I talked to in the DMV told me I couldn't get a DL until I got my GC. The second person told me I could get a DL with the same expiration date as my visa (and not expiration date of my I-94, which didn't make any sense) and that I could get a new one with my EAD. The 3rd person I talked to gave me a DL valid for 6 months. My point is, don't always trust what people from the administration tell you. They don't know their own rules that well.

Good luck in your visa journey!

Why go tomorrow? You will just be turned away and leave frustrated with no SSN.

Accept that you can do nothing about it until you get your EAD. You don't need the number anyway. Save yourself the frustration.

I went today as we wanted actual answers. Luckily we spoke to the guy weve spoken to before and he has all our paperwork on file. He verfired that they spelt my maiden name wrong the first time I applied so they couldnt find me. Pretty much just left me on the side without contacting me, my I-94 expired and now I have to wait for either my GC, EAD or AP. Once one of these arrive I can bring it in and get a number straight away.

I DO need my SSN though. I need it to register for my real esate course in order to get real esate licence here in Florida. I need it to take my Floridian driving test (only missing my SSN), I need it to buy my car (will be buying on finance) and a few other things. I know I dont need it for everything but I need it for the things I'm doing.

ya, having a SSA clerk look you up in the SAVE database, properly, is a must.

Many clerks are clueless for how to use that system, and it makes sense to make certain that the clerk , or the clerk's supervisor, makes a lookup in either VISA name or A#. I've been telling folk to withdraw the application if the clerk can't find you in the SAVE database.

have a read, when yer able?

I know I have started a similar thread with this topic before but I am STILL waiting on my SSN!!! I applied on the 20th March, thats over 12 weeks ago!

My AOS etc is being processed fine, went to New Orleans 2 weeks ago for my Biometrics and apart from one hiccup (forgot to submit my husbands tax return) everything else has been smooth. We have tried contacting the social security office but just get a load of BS. The last thing we heard was that the Dept of Homeland Security are withholding my SSN from me until I get my Green Card as thats the standard procedure apparently. I have never heard of this happening to any one else.

My husband called the other week and explained the situation as we wanted more information but not one person could help! They didnt even ask for my name or ref number and when he asked them if they wanted it, they said they werent able to search for me.

Does anyone have a number for anyone I can call to get to the bottom of this! By this rate I will have my EAD before my SSN! I cant register for my driving test or my real estate licence until I have my SSN and im so frustrated!

This happens from time to time. My wife was K3 not K1 and we had to wait for an EAD card before she could apply for a SS number. Sounds like they put you in the same situation as a K3 entrant.

i don't get it.

Louisiana, I believe, requires a SS card
