Seriously Frustrated Now! Help Please :(

I know I have started a similar thread with this topic before but I am STILL waiting on my SSN!!! I applied on the 20th March, thats over 12 weeks ago!

My AOS etc is being processed fine, went to New Orleans 2 weeks ago for my Biometrics and apart from one hiccup (forgot to submit my husbands tax return) everything else has been smooth. We have tried contacting the social security office but just get a load of BS. The last thing we heard was that the Dept of Homeland Security are withholding my SSN from me until I get my Green Card as thats the standard procedure apparently. I have never heard of this happening to any one else.

My husband called the other week and explained the situation as we wanted more information but not one person could help! They didnt even ask for my name or ref number and when he asked them if they wanted it, they said they werent able to search for me.

Does anyone have a number for anyone I can call to get to the bottom of this! By this rate I will have my EAD before my SSN! I cant register for my driving test or my real estate licence until I have my SSN and im so frustrated!

In 2006 I went to my local SSI office with the case law in hand. Applied for the SSI number and had in within 2 weeks. I am also in New Orleans. I went to the small office in Kenner. Hope this helps.

I live in Florida but had to go to New Orleans for my biometrics. I have been to my local social security office numerous times but I get no where with them. All they can tell me is that my SSN is being witheld from me but why they dont know

Your I-94 is expired now so you are out of luck. Something happened in that office, they didn't send in the application in time or something, but it's not coming now. You can reapply when you get your EAD.

You were eligible for a SSN as a K1 based your I-94. Since it didn't come through in a week or so, it is likely your name wasn't found in the SAVE database verifying your K1 entry. Had everything been fine when you went to apply, they would have said "your card will come in a few weeks". If they had to manually verify your legal entry with USCIS, then it can take awhile. So I'm guessing that your I-94 has expired so that K1 window of eligibility has closed and won't re-open until you get a new document of status like a greencard or EAD. or at least that's what they are telling you. At this moment you have nothing on paper showing how long you are authorized to stay in the US.

I've just checked my I-94 and it expired on June 9th. I tried calling USCIS earlier who said I had to call the SS Office again. Finally got put through to a very rude woman who said she couldnt help me, I had to speak to the USCIS again or go to my local office...then she proceeded to hang up on me!! I gave them all the correct documents and all my other stuff is being processed fine but even when I go to the office they tell me they dont know whats wrong :(

My husband and I will go see them tomorrow :( hopefully my EAD will come through soon as I am waiting on my interview for my Green card. Thank You everyone

If you go tomorrow, take the notice of action from the AOS with you (the one you got in the mail after sending AOS).

Your I-94 expired, but you applied for AOS before this. Apparently, in that stupid "#######" visa we came with, this is the only document we have to justify our legal presence in the US waiting for the EAD.

I got a DL valid for 6 months thanks to that paper (I went with my K-1 visa and the NOA, spoke to 3 different people, and got a DL valid for 6 months, before having my EAD smile.png )

I don't promess it will help, but you might want to try...

Why go tomorrow? You will just be turned away and leave frustrated with no SSN.

Accept that you can do nothing about it until you get your EAD. You don't need the number anyway. Save yourself the frustration.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

SSN office is correct, they cannot issue you a SSN until your status is adjusted. As per the new procedure they need to establish applicant's legal status with Homeland security, since you are in middle of adjusting your status Homeland security cannot verify your status and hence SSN office cannot issue a number.

I am not sure why you are so desperate to get SSN? There is not much you can do with SSN.

Well, if she gets her EAD and no SSN, she won't be able to work, right?

That can be stressful, probably?

For car insurance, you need the SSN too... They also ask it to open a bank account.

But there must be something to be done, surely. Because we are not illegals between I-94 expiration and GC approval.

A K1 has a 90 day entry. When that expires, they have no further documentation on paper from USCIS that says they have permission to be in the US. It's a period of overstay. The next document with a status and date is usually the EAD granting one year. We know that K1s are allowed to stay with no deportation while they await AOS, but the receipt (NOA1) does not say you can stay until x date. It is not dated proof of an extension of anything. So there is a period where a K1 is "out of status" as far as having a document to prove otherwise.

For removing conditions on the two-year greencard, the NOA1 from that filing states that this letter extends your status of permanent resident for one year. The NOA1 from your first AOS filing doesn't do that

I know that there is a time when we are "out of status" (which seriously doesn't make any sense at all. ) I am not sure the time after I-94 expires is overstay if the K-1 holder got married and filled and sent AOS papers within the 90 days. This is "out of status", sure, but I think it is not considered at overstay (or so I read on this forum)

I know there is no date on my NOA for my AOS. It still got me a 6 months DL. It is probably because the average time to get an answer for AOS is about 6 months. So as I got married and filled for AOS, I am legally able to stay in the country until I get my answer for the GC. So I can get a DL for that period of time.

I am curious, does the EAD gives a status? What is the status exactly?

EAD is just a work permit, when you file your AOS you are in the US at the permission of the US Attorney General till your GC is approved or denied. It is very important to read and understand the guides in VJ and the rules of engagement with USCIS, this will prevent future issues from happening, good luck.
