Good day everyone. Just a bit confused. I arrived here in US with K1 visa. I got married 2mos after my arrival. My husband went to the immigration agency closer to our place for my AOS. The agency prepared the I-130 and I-485.

My inquiry is: Should my husband need to file I-130 for me together with the I-485 per the agency told us to file these?

No, the agency should not be in the business if they think that you need a I-130 after marrying on a K-1 visa. You need to file the I-485 (AOS) along with the I-864 (proof of support by your spouse), and G-325a (bio page), as well as the Advanced Parole and/or Employment Authorization applications if you are interested in receiving either of those.

No reason for the I-130 if you are adjusting from a K-1. You are eligible to apply for AOS based on the approved I-129F petition and the fact that you married within 90 days of entry with a K-1.
