Hello everyone. I hope someone can help me with these confusion.

My son just got approved for an immigrant visa at the US Embassy manila last June 19,2013

In his visa page the category printed is CR2 which is the one we ticked on the i130 form when we filed because me and my husband (the petitioner) were married less than 2 years when we filed in december.

We celebrated our second year wedding anniversary last april 20, 2013 and my son will prolly poe by july this year.

My question is, are they going to upgrade him to IR2 instead or CR2 once he gets here?

September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

As long as he enters after your second year of marriage he should be an IR2. This is something you can call CBP or USCIS to talk about though as well.

thank you :) well tried to call uscis 2 times yesterday and the guy i talked too seem to be either drunk or high if not both lol. he even asked me what is cr2 and ir2 lol. at the end i ended up hanging up coz i asked my call to be escalated to someone else and i placed me on hold forever

Wow that's ridiculous. I may have to call USCIS in the near future and I am dreading it...

So - I am not 100% positive, but I am pretty sure I have read about others in a similar situation (spouse visas) and the advice was to make sure at POE that the person writing in the stamp that endorses the visa writes IR-2, not CR-2 - in other words, tell the person before they take the passport to endorse it. Have ready evidence of your marriage date to make sure they realize you have been married for more than two years.

CR-1 - 2008
January 7 I-130 sent - APPROVED in 106 days.
Interview - APPROVED 175 days from NOA-1 date
ROC - 2010-2011
October 5 - I-751 sent APPROVED 111 days from NOA-1 date, no interview.
NATURALIZATION - 2012
APPROVED 79 days.
May 9 - Oath ceremony - in Oakland, CA.

IR-2 - 2012-2013

Nov 15 - I-130 sent. NOA-1 received from MSC.
Jan 22 - APPROVED 65 days from NOA-1. Never transferred to field office.
---NVC---
Feb 4 - received @ NVC
Feb 26 - Got NVC Case # and Invoice ID #
----------------------------------slowing down the process a little... stepson can't come till nearly July-----------------------------
March 19 - Sent e-mail Choice of Agent, without scan of DS-3032. Paid AOS fee ($88).
April 1 - Choice of Agent information accepted (10th "working day" to accept).
April 3 - IV invoice appeared. Paid IV fee ($230).
April 11 - Sent IV package and AOS package TOGETHER. Confirmed delivery April 15.

April 26 - Case Complete (10th working day)

May 14 - Interview date assigned (12th working day)

June 5 - Interview in Sofia - VISA GRANTED!!!

June 16 - POE @ SFO. No problems. He's a citizen now!

Oct 4 - US Passport received. (SS card received some time in the summer; had to go to SSA office to obtain)

yep crazy isnt it. were paying tons or money for them to hire people that would help you get thru your process and end up youre more educated about this entire thing than them OMG!

Yes, you should be upgraded at POE, you can mention it to the CBP officer when you enter.

10/14/2000 - Met Aboard a Cruise ship

06/14/2003 - Married Savona Italy

I-130

03/21/2009 - I-130 Mailed to Chicago lockbox

11-30-09: GOT GREEN CARD in mail!!!!!!

Citizenship Process;

1/11/2013: Mailed N400 to Dallas Texas

3/11/2013: interview.. Approved

4/4/2013. : Oath! Now a U.S. citizen!

Hi everyone! This is an old thread but I am still curious what happened with that upgrade? My situation is: after my husband sent i-130 for me and his step-children, I was assigned IR1 and my children CR2. At the moment of petitions approval we had been married for almost two years. I could not understand why it was so different for me and the children? I also wonder whether they will upgrade my kids status later on as we have been married for almost three years now. The actual interview is still ahead. Has anyone had any experience to share?
