We got NOA2 on April 24, 2013, I assume she was notified of this but have no idea, we haven't spoken since February. I have three questions:

1. Should I attempt to cancel the K1?

2. If yes, how do I go about that?

3. Will this affect my chances of having another petition approved if I should meet someone else abroad?

1. You don't "cancel" the K1, you haven't filed for a K1, you filed a petition. Yes you should cancel the petition.

2. Call NVC (phone number here: http://answers.yahoo.com/question/index?qid=20100410161806AAqqXTb) to withdraw it. Also write to NVC (include a copy of your NOA2 - petition approval - so it's easy to find you case information). Also send a copy to the email Karee gave.

3. I believe you're restricted on the number of times you can apply in a 2 year period (it's explained in the instructions) but it's not usually a problem. It is best to withdraw it instead of just letting it die. It ties up loose ends not only for you, but also for her.

Step back and think about why you got engaged in the first place, that is a big step to begin. Make it work, and give chance a try, you can always get divorced, decisions are never permanent, and maybe your life with her will be better. Otherwise you'll wonder what if, I guess your choice.

She walked out on me despite my attempts to rescue the relationship, so no, not really my choice.

If you havent spoken in four months, the break up seems pretty final to me. My husband and I broke up a billion times, but maximum we could do without talking to each other was 5 days, even when we both tried dating other people and living normal lives in our countries. Lack of communication on both of your parts seems like a bad sign to me.

Don't marry to "give it a try". I don't judge anyone's reasons for getting married, but I do believe that generally many people tend to take this kind of thing less seriously than it should be taken. I see marriage/serious relationship as a commitment and decision you make every single day - to be with that person. To build a future with her/him.

Having said that, I do believe in trying very hard. I never considered it to be waste of time/money/whatever. If you want, you could call her and see what's up if you still want to give it a try. Do not mention the NOA2. You don't want her using you for a green card (I am not saying that she will, but it happens). Just tell her you were thinking about her and wondering how she was. If you guys mend it, great. If not, nothing happens. You can and should cancel this petition.

I am sorry you had to go through this. Hopefully the next person you meet will live in the U.S. so you won't have to go through this process and distance twice. It sucks. Good luck with whatever happens. smile.png

Yes, it was pretty clear to me months ago that the relationship was over. I agree people don't take marriage seriously enough, in fact we had discussions earlier in the relationship when she began dropping not so subtle hints that she wanted to get married and I explained to her that for me marriage was for life and even though I loved her very much I had to take time and be sure. Eventually I decided that it could work out between us, but I guess I was wrong.

As far as calling her goes, I don't really think it's a good idea. I mean, I miss her horribly, in fact I still love her, but her behavior was so hurtful and our fights so brutal that it seems pretty obvious we could never have a happy marriage. I don't want to get into the gory details, but believe me, us getting married would be a mistake. At least I found this out before we got married and not after.

The calling her idea was more in the lines of "Do not marry her to try it out, if you want to try, try a phone call". :)

I am glad to hear the way you are thinking. Being hurt, but knowing it is for the best bring a certain kind of piece. You know what to do next. Once again, good luck. :)

Why would he call USCIS and try to cancel an approved petition? It's in the state departments hands now.

Contact the U.S. Consulate in Bangkok and inform them that you are not moving forward with your support of the visa. You can try sending them an email at visasbkk@state.gov. Use your BNK case number as the subject line.

If you don't get a response with that email, try visasbkk2@state.gov The first one I posted is more of a general email, and not one for people with pending business with the Embassy. Sorry for the mistake.

As to your situation, I don't know the details, but from what little I know from what you've posted I think you are doing the right thing.

Hi eric and june. My fiance broke up with me 2 weeks ago. The reason why we broke up is that he met someone that he likes in there and that he doesn't know what to do anymore, that's why i said we should end thia. He's in the US and i'm back here in the Philippines now. I was so hurt of what he did. Our petition was approved 1 week after the breakup. I told him about it but he said he still doesn't know what he really wants. So i said to him i don't want anything that connects to him. And now my question is "is it possible for mw to cancel the petition/noa2?".. Where you able to do it. It's different in my situation coz i'm not the petitioner. And what i want right now is to cancel it and move on with my life.. It's already really hard for me.. I was living in the US for a year then i saw him and we decided to have a fiance visa so that we would be together again, we build dreams, imagined our future and all of that. It only took us 5months for the petition to get approved. 2-3 more months and i would probably be back to him.. But things happen and i just need to be strong and move on with my life again..

Please help me on how to cancel the petition. Thank you

Since you are the beneficiary, there's really nothing that I can think of that you can do. Just ignore any correspondence from the embassy. You might send them an email with your case number and let them know you are no longer interested in pursuing the visa.

Somewhere on this forum I remember seeing a letter someone posted, a notification saying that their K1 had been cancelled. There was a line on it that indicated who cancelled the petition with two boxes, one for petitioner, and one for beneficiary. I tried to search for it again but could not find it. So many people here seem to think the beneficiary cannot cancel the petition, but why not? If that person lost interest in coming to the US it seems like a pretty good reason for the government to cancel the petition.

Somewhere on this forum I remember seeing a letter someone posted, a notification saying that their K1 had been cancelled. There was a line on it that indicated who cancelled the petition with two boxes, one for petitioner, and one for beneficiary. I tried to search for it again but could not find it. So many people here seem to think the beneficiary cannot cancel the petition, but why not? If that person lost interest in coming to the US it seems like a pretty good reason for the government to cancel the petition.

The beneficiary can't cancel it because it's not your application to cancel. It's paperwork filed by the USC, so the USC has to cancel it.

I called the NVC today and they told me because the petition was approved and sent to the embassy already there was nothing they could do, I would have to contact the embassy directly. I already planned to do this but also wanted to see what they would say about any other steps I should take. Yeah, they pretty much just told me to call the embassy.
