I-864. Possibly the most confusing form in the world. Help please

Trying to complete the I-864 with my wife bad father in law and we're struggling with some of the questions.

Hopefully you guys can help us.

Part 4

We currently live in the uk but are planning to move to the US when I get my visa. What address do we out in for the sponsors address and place of residence as this is likely to change soon.

Also, what type of proof are people submitting to prove intent to move.

Part 6

When we move my wife will be leaving her job and then looking for a new one, do we still list her current salary in part 6 even though it will have finished before we get there. Are do we list the salary for her new job which she'll be starting when we get there?

I'm sure there will be more but these are really stumping Me right now

I'm not sure which address you ought to put, but the dept of state lists some ways a person can show they're re-establishing domicile.

It's a bit different for us, cuz husband is already US employed and only on a temp visa here.

We're using the address we'll be staying at when we first move on that form, altho we will likely move a month later (crashing with a friend while we flat hunt).

For income, you can't put anything now that's going away, and if your wife doesn't have a new job yet, her income should be logged as $0. Same for you if you don't have a US job yet.

If you already have US employment, that's good since that helps your domicile requirement.

Put the current address of the sponsor. Once the move takes place, use form I-865 to notify USCIS of the new address.

Current salary is what they want. It will need to match what is shown on her recent tax returns.

The wife is UK. She doesn't submit evidence. Her US salary is currently $0.

Here is what we did

Mailing address was my foreign address

Place of residence was my parents US address. We changed it to another address at the POE because by then we had set up an apt lease

Country of domicile was the foreign country where we lived

Current income was foreign income based on job in the foreign country

I don't know what they do in the UK but they interviewed us both in Riyadh. My US drivers license was current, we bought a car in the US the year before and just left it there, and our bank accounts / credit cards were all US-based. The car registration, insurance, bank accounts, credit cards, and our mobile phone accounts were all addressed to my parents, which was the place of residence on the I864. For proof of intent they checked with me and I laid it all out that we started planning to return to the US the year before and this is what we had done to get everything ready to move back.

I would suggest the OP download and read the instructions for filling out the I-864 from the USCIS website. http://www.uscis.gov/files/form/i-864instr.pdf

As long as the sponsor is legally domiciled in the US his/her salary abroad may be used to sponsor a beneficiary. Their "US salary" is not zero.

Has the sponsor been filing US tax returns?

My wife (the us citizen) has been living and working in the uk for 5 years but we will both be moving over in November (fingers crossed).

Her job is definitely ending but she has an offer of work for when we get there. We are also renting a house and have a rental agree,net on its way. My wife has us bank accounts, credit cards and a car still resisted in her name so hopefully we'll be ok on proving intent.

Father in law is co sponsor so no worries on meeting minimums.

I'm going to go with our current address and the our new address for the residence unless someone else comes back.

No problem.

Medical is on Wednesday. Not quite as nervous as I was. Long story short, I ended up in hospital last week and had blood tests and chest X-rays and everything came back good so not too worried about it.

Bit annoyed as my GP has lost my vaccination records so it looks like I'm going to have to get things redone,

Am I right in thinking its only MMR and tetanus that an adult needs?

Yea, sent them back last week and had my medical on Thursday. They should have the results from that by Tuesday. Then I HOPE we hear something in the next 2 weeks. No interview yet. I don't know if July is all booked up yet. Guess we'll see...

It sounds like you are unsure of whether you will be moving to the US. You should be sure before you continue the visa process with NVC. The visa once received will expire (I believe 6 months). You can travel to the US to activate the visa but by that point you should already have definite plans to reside in the US.

The NVC should hold your case for one year if you need time to determine your plans.
