National Benefit Center, where all AOS cases are sent. Yes, it will only go to your local office if you are to have an interview. When adjusting from a K-1, about half get approved without interview. It typically takes longer to be approved without interview.

What are the chances of getting approved without interview, i mean what makes them approve the cases without interview? Overwhelming evidence that they don't feel the need to interview the couple? Or depends on the location, state to state rules? And how long it takes to approve w/out interview?

I am on a B1/B2 Visa.

6/19/2013- ALL Forms Sent to Chicago Lockbox- (i485, i130 with rest)

 

 

6/21/2013- Package received in Chicago Lockbox

 

 

6/26/2013- Email and Text Notification received in the evening- Package received and accepted at USCIS smile.png

 

 

6/28/2013- They cashed the checks- $420 + $1070 = $1490 smile.png

 

 

7/2/2013 - USCIS Mail notification received (all the forms are received and are in process)

 

 

 
7/3/13- Biometrics letter received- for 7/19/13- Day 13
 
7/9/13 - Early biometrics done! - Day 19

 

 

8/5/13 or so - Status changed for Ready for scheduling

 

 

8/20/2013 - INTERVIEW SCHEDULED FOR 9/20/2013

 

 

8/21/2012 - Interview Cancelled! ;(

 

 

8/22/2013 - 2nd interview scheduled for 24th September.

 

 

8/27/2013 - Online update - EAD card ordered!

 

 

9/5/2013 - EAD card received

It is just a random 50/50 chance. There does not seem to be any pattern to it. That only applies to those adjusting from a K-1 though. You will definitely have an interview.

I met a guy here in VJ he applied for his AOS 1 year LATER after his I94 expired. He got his greencard without interview

This week one Brazilian people of my facebook group was arrested by ICE for 4 days, one of the reasons she said it was too late to have applied AOS.

I don't understand, she was arrested for applying late? or randomly arrested ? what was their status?

Being married to a USC does not protect your status. It sounds like she was picked up by ICE for unlawful presence, as she was out of status. You are not arrested because it is too late to file for AOS. If she was out of status because she overstayed whatever visa she used to enter the US, filing for AOS after getting married would have put her in a new period of authorized stay and she could have avoided being detained by ICE.

Is there a time limit to apply after you have been married? Do they have to do the medical exam again??

You did a K-1, and the OP is adjusting from a tourist visa. There is no deadline to file for AOS as long as you were married within the 90 days of entry. The K-1 medical is only good for a year, so if your exam was not within a year of filing, then yes, you need to see a civil surgeon for a new medical. If your I-94 has been expired for 180+ days, then do not bother to file the I-131. Just file the I-485 and I-765. Do not leave the US until you have your green card.

Thank you so much for your response. Things have been pretty delayed because we had a baby an I'm the only working so spending over $1000 just isn't easy right now. It sucks that he will have to get another medical but hey that's our fault. Thanks again!!

Consider it an investment. The sooner you file for his AOS/EAD, the sooner he will be able to work and have another income for your family. :)

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.
