I know that some people on this website have said that it's still acceptable but i still can't stop wondering if they're going to give me some grief over the fact that my i94 was expired in Jan 2013 and we sent the package only this month. Actually few days back. Do you guys have any idea if our process is going to be complicated because of that? Anyone experienced similar situation? cray5ol.gif

I expired in Dec, applied in April. It has no bearing on your process.

Don't worry, it's optional. :) It's a temporary travel authorization, while your AOS case is pending adjudication. I don't know exactly how long after your I-94 expiration date you filed for AOS, but if it's more than 180 days, filing for AP would have not been a good idea.

But you didn't file for it anyway.

They said it expired in Jan, so it has only been 5 months. They can file for AP and the EAD now if they did not do so with the I-485.

Sometimes the green card approval can take awhile, so having the AP is for just in case something comes up, such as an emergency that would make you need to leave the US. The AP will allow you to re-enter while waiting on the green card. The I-765 and I-131 fees are waived when filed with a pending I-485, and the I-131 is a short form, so filing for it is pretty easy and free.

None. Your case will either stay at the NBC and be approved without interview, or transferred to your local office where you will have an interview.
