hi everyone,just wanna ask something on behalf of my friend.so here is her story,her husband filed a k1 visa for his exfiance but his exfiancee broke up with him and ofcourse she didnt pursue her petition.the exfiance already had her noa2 and as far as i know,she only needs to do her interview.i believe that this k1 petition was filed last 2010-2011.after over a year the guy met my friend and married her last jan.2013 they have a kid and he wanted to file a spousal petition for her but their problem is that this guy,my friends husband didnt cancelled the k1 petition that he filed for his ex fiance,so heres the questions:

1. can they file a petition without cancelling the previous petition that her husband filed since it was over 2 years ago?

2. what can they do for now?

3.if they really need to formally cancel it,whats the besst way to do it?should they send a letter or just call the uscis?

4.how long will it take to cancel a previous petition?

i would love to hear from you guys.thankyou.

yes send a cancellation letter first

send it to the address on the noa1 (make sure there is a delivery receipt)

confirmation letter will arrive in less than 30 days

filing can probably be done once receipt has been registered

when filing the 130, send the copy of the cancellation letter with the noa2 and the confirmation of cancellation if possible.
