Hello,

I am on OPT extension right now. And my opt extension is valid till March 3rd 2014. I am engaged and going to get married to my fiancee in Oct/Nov 2013. I heard it takes about 3-4 months to get my EAD/GC approved. But my worries are if it does not get approved by then and we dont get any interview date or anything and my OPT extension card get expired then does that mean that I will have to go back to INDIA? and wait for my interview date to happen in INDIA??

Can I still stay in US and continue working until my EAD or GC get approved??

Please let me know what should be the process? and is there anything I need to be worried about as far as getting my GC/EAD process is concerned?

Thank you for the response.

I am planning on filing my I-485 by the end of October so I think I should my EAD by January or Feb max.

Also, if I have to file the waiver form because for some reason my EAD got rejected then does that mean I have to leave or can I still stay and continue fighting until my waiver form gets approved and comes with my EAD?

What waiver form?

There's no reason for an EAD filed in conjunction with a non-frivolous adjustment of status application to be rejected. Even if it were, it has no bearing on your ability to stay in the country.
