Rejected because of major medical?

We will be submitting our I-130 next week. Two weeks ago, my spouse had a stroke, and subsequently, they found a hole in her heart which may have to be fixed by open heart surgery.

I have read a lot about the medical examination, and it appears that what they are looking for are communicable diseases like tuberculosis and syphilis, among others.

The surgery should fix her heart condition. Will this kind of medical history (stroke/heart) keep her from being approved?

I don't think it will, but I should would like some validation from someone who has had a similar experience.

Thank you.

No, not at the petition stage with USCIS (Your wife's medical issue will not have any bearing on petition approval).

However during the interview/visa approval process at the consulate, medical is required - which is a big part of the visa approval process. As at now no one can tell or predict your wife's health condition for an interview which is a year or so away.

I would advise that you focus on getting the petition approved first, then go from there. Good luck!

Hey,

I don't have an answer, as I'm not entirely sure, but I commented on a thread yesterday for someone asking about their partner with a pre-existing condition requiring on-going medical care. Hopefully, your fiance will be all on the mend by the time your medical and interview happen and the conversation will not be about on-going care, but just in case or if the info I linked to in this thread helps... http://www.visajourney.com/forums/topic/437087-dialysis/ Mostly, you just might like to see the link to the reasons they *can* deny on medical grounds, of which old conditions *should* not be one. It may well be that if it's a case of medical care, it ends up falling under a financial requirement.

There's no way on Earth your fiance will be the first person to go for a US visa with a previous heart condition, so I'm sure this cannot be a deal breaker. I assume she's in Australia? It may be worth researching specifically how medicals go in Australia and what sort of information they need to give a pass mark (try the local area section of the forum).

The above post is correct - the I-130 petition asks no questions about health, so don't worry about it at that stage. It has no bearing.

P.S. Best of luck in her surgery, and good luck on your immigration journey. smile.png

Hi Sukie.

How did you go with your medical and the heart condition? Did you require any evidence of it all being alright or anything?

:-)
