Here's the situation: My wife's case is currently at the NVC stage and I just paid the AOS bill, so I'm about to submit the AOS package. However, we have just decided to file an I-130 for her son (my stepson) as well. It has not even been submitted to USCIS yet though. Can I file the I-864ez for my wife now, since she is the only beneficiary on her particular I-130? Or would I have to file the normal I-864, knowing that eventually I will be responsible for 2 immigrants? Thanks for your replies.

No you should wait on your wife's and when you submit your sons at USIS in coverletter ask to expedite so they can marry up the petitions. That way you are paying only and they go together.

Put your wife's case# in letter letting them know you have a case at NVC. Hopefully they will get it through faster.

Agreed with Dwheels, you can include a copy of your wife's NOA2 in the filing to show she's already been approved and in the cover letter explain that you'd like to expedite through the USCIS to marry the cases up at the NVC so they can be interviewed together.

Basically we're telling you to slow down on your wife's case until your step-son's can join it.
