I could use some advice, or opinions.

Hello, this is my first post, I have read a lot, on this site, and gathered much information. I have a few questions, that I would like opinions on. First I will tell my story !

As my timeline states, I was married in Shenzhen, China on January 18, 2013. Filed I 130 on 2/07/13 Received NOA 1 on2/14/13 Filed I 129-F on 2/19/13 NOA1 2/28/13 ( I was told, our processing would go faster, if I filed both. I'll quote Humphrey Bogart, in the movie Casablanca " I was misinformed" )

Having heard nothing, on our case. I contacted our Senator's office. I downloaded the privacy form, from his website, and printed, most of my papers, that I had sent off. I like to speak to people, face to face, so I brought the papers, to his office on 5/28/13. On 5/31/13 one of his staffers called me, and said, they would send out a request for information. 6/4/13, I received standard form letter, saying they will look into my case, and other political rhetoric . On 6/19/13 I received another letter from the Senator's office, saying my case, had been transferred, to our local office. I will attach a copy, of the letter, with the post. As the letter says, they will contact, our local USCIS office.

I have schedules an infopass appointment for the local USCIS office on 6/24/13 9:15am

Questions:

1) Should I wait, until I hear back, from the Senator's office ?

2) What questions, should I ask ?

3) The letter states, on 3/15/10, the local office received our case. Does our time start over, from 3/15/13 ?

Apologizes for the long post, and for asking simple questions. I don't know a lot about the immigration process, only what I have read, and experienced, first hand. My wife asks me every night, if there is any progress, in our case, and I hate telling her, "No" but I understand, that many people have waited much longer, for any results. Thanks in advance, for any help or assistance.

You have been waiting a little over 4 months. Usually it takes around 6 months to get approval. Why don't you join a monthly filers thread for February and compare with other people? I bet you will find that no one has been approved yet.

So, to clarify, did you withdraw your I-129F, or do you still have both pending? I may be wrong, but I would imagine that it would be important to clear that up. Otherwise, you could run into misrepresentation issues, since you're already married and the I-129F is for people who plan to marry in the U.S.

First off, thanks for the quick reply, for whatever it's worth. Secondly, I do read the February filings link, almost everyday. For February, on Igor's list, it shows over 90 people, and over 40 approvals. I guess, you would lose that bet, HUH ? Finally giving inaccurate or mean spirited advice, is not helpful, or encouraging.

So, to clarify, did you withdraw your I-129F, or do you still have both pending? I may be wrong, but I would imagine that it would be important to clear that up. No, I filed for the I 130, and then filed for the I 129f (K-3 Visa) I was told, it would go faster, that way.

Oh, sorry! I totally forgot about the K3 visa! My mistake. I've heard on here that most of them get administratively closed, so it's a good thing you also filed the I-130! Sorry I have nothing more useful to contribute!

My experience with contacting the senator's office was good. My NOA1 was Jan 30th and just got my approval today (140 approx days). I had spoken over the phone with one of the senator's aide...and he was very helpful. As soon as he had the updated information on the case - he contacted me.

a. Initial contact to the senator - Mid May

b. Their response regarding the status of the case. (the letter mentioned my file was scheduled for review on June 17th) - June 1st week

c. Follow up call to the aide regarding status - requested him to call and update after my review - June 19th

d. June 21st - call from their office regarding approval

I do understand he may have had nothing to do with respect to pushing the file to be reviewed ahead of the normal processing times..but I was just happy with someone looking out for me...Based on other timelines i've seen so far, most of the ones in January were already approved...so mine had to be coming..but having the information or having someone reach out on my behalf meant a whole lot more..

Looking at your timeline - you're not too far off...should be coming anytime soon :)

No problem, I followed the instructions, from the USCIS website, and how to file the I 130, and use the receipt, from that, to file the I 129F. I didn't joined this site until later. Had I joined this site first, I wouldn't of filed the I 129F. Yes, I also read, that almost all K-3s get closed, and they process the I 130

I really don't understand your question about the local office

you are within processing times

you contact your senators office for help

you make an appointment to the local office

and now... you want to know what to ask???

there are a lot of folks here using their senators who are well past the five month mark and being that you are inside processing times, I am not sure what you were expecting as a response.

you time will not start over at the local office, you are still in que

looking at your local office, they are backed up...it appears you will be waiting five months, maybe more

Yes, my Senator's office, has been very helpful, and it is nice, to have someone looking into our cases, and providing some answers.

I can only hope, for an approval soon, I would be happy, with an approval, by the end of July, or even August ^__^

what do you want to find out here? don't you have your own questions

you can ask.. what month are you processing, the answer will be, we do not have that information

when will my petition start being reviewed? your answer will be as soon as we can get to it

can I start a service request? your answer will be no

so yes, I am responding to your statement.. someone with actual infopass experience

and really I do not wish anyone to have to wait as long as they do... sorry if you took it that way

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

The general waiting time for an I-130 petition approval is from 2-8+ months. Anytime after 6+ months and you're out of normal processing times so until then, generally speaking, no one will do anything to help you out. We've seen a few more K3 sneak through lately because the local offices are so slow on the I-130. You have a chance to be honest, in that direction.

I suggest taking a look through Darnell's profile and he's dealt with some major issues and had political help. I do hope you can get everything cleared up.

I was personally surprised at having the I-130 approved in 4 months as I expected it to take from 6-8. Yes we were prepared to sit there and WAIT because it's the government. That's what you do. As my husband is fond of telling me, they're slow as ****. LOL (He works for the govt btw...) But for you I do suggest, highly suggest, that you update yourself on the process ahead as well as trying to move your current situation along. Study the NVC stages as you and your spouse will be able to utilize electronic processing. However there are very specific steps you need to do for EP in China and there is a wiki on this website that you should know inside out and backwards. :)
