hello Everyone,

I'm a little new to this process especially since it has gone so fast for me. I just wanted to know if anyone clearly knew how this administrative process works. I just don't understand how it's decided which file get puts on administrative process and who ultimately makes that decision. My fiance interviewed last week and they didn't take his passport away, he just did the finger printing and they put in his passport that he was applying for a US K-1 visa (not exactly sure what they put). Then after the interview they told him that he wa going to have to wait around 15 days until they notify him becuase he was on Administrative Process. I'm just so confused on how all of that works. I definently know that there are people on here who have waited more than months and even years. I just want to know if it's something that the consular agent does at his own discretion or do ALL files go through administrative process. Did they turn in his finger prints or name to a data base where it came out that there was a name hit?? I Called DOS today and they told me that it was still pending and that it started after his interview...? So why are there people that pass through the interview without this process :crying: i'm so confused. If anyone could shed light on this or lead me to a web site that explains how this works it would be greatly appreciated. I also did speak to one of the agents at the embassy and they told me to call them after 14 days if it still had not been processed, does that mean that they have some pull over how this whole thing works?? Go figure

Sorry to hear that you were put on AR. Did officer advise your fiance why he was put on AR? I know some countries automatically do it and run fingerprints on everyone.

However if there was a namehit - probably have to send fingerprints to Dept of homeland security which is when fingerprint clearance can take much longer.

I wouldn't worry if officer just said 15 days.

11/27/06: recvd letter from CDJ - Appointment set for Jan 11, 2007

1/11/07: Visa received!!!!!

5/2/07: AOS transferred to CSC

Thanks for the advice, i'm still not sure how the whole name "hit" thing works. I'm just praying that this doesn't delay for to long. take care

From what I have been told - when there is a name hit DHS has to clear the prints, not consulate. That is why it takes longer when there is a name hit.

Are you certain they told your fiance he had a name hit? If he did - it could take longer than the 15 days.

Did they take all 10 prints or just his 2 index?? Don't get too worried if you read my timeline. I'm dealing with the second busiest consulate in the world. My fiance's prints were cleared 2 months (Oct) after they were sent to DHS and I'm still waiting for CDJ to send me appointment letter for visa pick up.

Okay now this is where I should try and get all the info, because now I know that it makes a difference. They didn't tell him that he got a name hit, i'm just assuming that, what I do know is that they told him that it could take up to 15 days. I'm going to call him and ask him tonight if they took all of his finger prints or just the two. I don't know though because I'm under the impression that they took his finger prints at the end, I could be wrong because I think they do it at the begining.uuuuh this is just so frustrating, okay so all i can do is be patient. thank you so much for your help :help:

My impression is that it depends on which country the person is from and whether it is a man or a woman.

Anyways, maybe I'm totally wrong!!! As I said, this is just my impression!

When you go to your interview they take your name and submit it to all kinds of agencies that track terrorist activity or watch lists. If your name is similiar or someone else has the same name they call that a HIT. They then must rule out that your SO is the person or persons that the name is close too.

Anyone coming to the USA has to have AR/AP check but in most cases they are cleared within days. All T countries the men are scrutinized more closely.

For petitions and application filed in consulates, there are other security checks involved.These are: (1) Visa Condor checks which arise from information disclosed on a Form DS 157 or because a person is from designated terrorist countries like of Iran, Cuba, Syria, Sudan, North Korea or Libya; (2) Visa Mantis checks relating to an applicant, who because of his actions or background, may be involved in the transfer of sensitive technology; and (3) criminal background checks which arise from a hit in the National Crime Information Center (NCIC) database or from other sources.

They only took two fingers for the finger printing, and that was the first time in his life that he was finger printed. okay the saga continues, however tomorrow is a new day. Take care everyone and thanks for the help
