Just wanted to add my progress for anyone thats interested since yesterday - when we got our Case number 28 days after receiving NOA2 and 6 days after receiving notification that it had been shipped from TSC to NVC:

- Status at NVC had changed to 'In Transit' by the end of the business day, which I take to mean its now enroute to the embassy in London (w00t!)

- With the Case number I booked medicals for myself and my two kids with Knightsbridge Doctors just after 9am this morning - first available appointment date was Weds 7 Aug.

Thanks for the pointer to look at the London forums too. GL everybody.

No, its actually considered an immigrant visa. So choose that on the CEAC website tracker and it should show current status of your case number.

They are still considered a non-immigrant visa, but the consulate (at least in London, handles visa based on intent. If the intent of the visa is for a temporary stay in the US then the non-immigrant visa department handles it, and if the intent is to move to the US as and establish residency, then it's handled by the immigrant visa department within the consulate. I read this while browsing through one of the chat logs from a past chat session. I'd put a link to it, but I don't remember which one it was and there are quite a few of them.

A gotcha! that makes more sense as to why all the paperwork I have filled out says non-immigrant then. Thanks everyone for the clarifications!

yes, it's a little bit of a murky in between type of visa. They know you plan to immigrate, so the consulate handles the applicant (beneficiary) as such, but since it's just a fiance(e) visa, it gives you the 90 day window to change your mind and go home without any issue, thus the non immigrant status. Once you marry and adjust status, THAT is when you officially become an immigrant.

Actually when you go to the CEAC website to check the status, if you read the whole box that pops up, it tells you the date the case was created (this is the date the number was assigned) and the date it was last updated.

Angelina,

My case just got shipped to NVC and will also eventually go to Naples. Could you elaborate on what you mean about making the consular appointment? Why does it take longer with the online...that seems counterproductive?

Thanks!

I just got off the phone with tier 2 from USCIS. He told me he can't see if it has been shipped from the service center yet. Then he put me on hold while he called VSC to inquire about it. When he got back on the line, he said that I should receive a notice in the mail on Aug. 7 at latest saying that my case has been shipped.

What is the point of it just sitting there? Why is it so difficult to just forward it to NVC? Why should it take 38 days to forward? :( This is making me crazy!

I don't understand why it takes so many weeks to send the cases over...I had to wait 3 weeks but I thought that was because TSC didn't realize the K1s are supposed to be expedited at that stage...as for VSC, that shouldn't be the case. I also don't understand how they know it will be 8/7 -- if they know that, why not just process it? sorry - the whole process is so frustrating. :(

Thanks :) Yeah...I don't really believe the 8/7 thing. It is not like that is some special "shipping day" or anything. And there are obviously cases that are going straight through and getting a case number within a couple of days. I guess the frustrating part is that every time I call, I get told something different. I have been told the USCIS has "up to 90 days" to forward cases. Also, after putting in a service request was told to wait "30 days from the notice date." That one was especially funny because I received a physical letter in the mail to tell me to wait 30 days. With all the effort it took to send me that letter, why not just forward the petition? Hopefully I hear something from NVC soon!
