USCIS Sent My Immigrant Visa Petition to the NVC. Now What Happens?

If your Priority Date meets the most recent Qualifying Date, the NVC will:

  1. Invoice you for your visa application fees
  2. Collect your visa application and supporting documentation
  3. Hold your visa petition until an interview can be scheduled with a consular officer at a U.S. Embassy or U.S. Consulate General abroad.

If your Priority Date DOES NOT meet the most recent Qualifying Date, the NVC will notify you and hold your petition until your Priority Date meets the most recent Qualifying Date. The Department of State updates the Qualifying Dates on a monthly basis.

Has anyone been invoiced or notified that they do not meet the qualifying date yet? This is the link for July's bulletin where they post the priority date (USCIS approval date) that they are currently working on. http://www.travel.state.gov/visa/bulletin/bulletin_5993.html (the bulletin is only updated once a month) If you go to that site you will see that they post a date of June 7th. I don't think that any of us VSC to TSC transfers have approval dates before that. Also on the bulletin it says that the F1 applications are oversubscribed and they have a chart with the retrogressed dates, however it is a little confusing... can they really have retrogressed the date to june 1st 06 ?? Anyone else know anything about this??

December 31, 2012: Petition received

January 2, 2013: NOA1

January 8, 2013: Officially engaged <3

May 30, 2013 : Transferred VSC to TSC

June 26, 2013 (175 days) : NOA2

July 22, 2013 (26 days) : Sent to NVC

July 30, 2013 : Arrived at NVC

July 30, 2013 (8 days) : Received case number

August 9, 2013 : Fiance received packet 3

August 15, 2013 : Medical

September 26, 2013 : Interview : AP additional medical information needed

October 11, 2013 : 2nd Medical appointment

October 31, 2013: 2nd Medical report picked up by Embassy courier

November 21, 2013: 2nd Medical report received and our case with with an officer for review

January 17, 2014: Refused (found inadmissible)

Filing a waiver to lift the inadmissibility....

How were you able to get an interview without the embassy having the file? You're so lucky!

the embassy gave me the interview date. after we got n0a2 on 21st june they gave me a call 24th june. so i highly believe just as n0a2 says the case was forwarded to the listed consulate its very true. maybe uscis forward the case both to embassy and nvc

If your embassy stated it has not reached the NVC yet, this means that they will cancel your appointment if the file does not reach the embassy in time. It means that in your specific case, your country sets a interview date in hopes of receiving the file in time. I have not heard of many files skipping NVC without there being an exception...and your file is still going to NVC first.

That is for other immigrant visa petitions. The K1 is a non-immigrant visa, though it is treated as such in a lot of things. The NVC don't invoice any K1 filers. We don't have priority dates either. That is for other types of visas, like for brother/sister/parents etc. Ours should have been sent to the NVC and at the embassy already. The K1 is usually not at the NVC for long at all.

Saw this posting ... Are they a Texas transfer????

Vivian and Warren are really from Vermont and petition wasnt transferred to Texas. Who's the other one?

I am certain as we speak no one from our batch of Dec and Jan filers being transferred to Texas got a case number yet.

It would have been a big relief in our part to hear a transferred petition in our batch got a case number already.

It would mean ours are on their way too. and not having to wait for 8 weeks from NOA2.

Oh right, my mistake.

No probs, just didn't want you getting confused. With other certain types of immigrant visas, you have to wait for a priority date before you can continue with the processing of that visa, and the NVC process the petition and the AOS part if it and invoice you for the fees and assign you an interview date. With a K1, we pay later on at the Embassy stage and then we file AOS once in the US, and it isn't the NVC which assigns us an interview.

Spoke to my senators office they are making an inquiry,,,,, for some reason the tsc is holding our approved k1 cases for 8 weeks sad.png

Are you inferring that TSC is holding the cases for 8 weeks b/c of the customer service responses, or did your Senator tell you this?
