Hello there!!! I am a Jan 2013 (16th January) filer & got transferred to TSC last month. At the time of submission of I-129F, we have submitted a scanned copy of my G325A form & letter of intent. I am the beneficiary. And I am expecting a RFE for the same. But just wondering, is it possible that sometime they approve my K1 application with scanned copy? Because it has been 5 months now since we have applied for K1 visa & haven't received any RFE yet. Is there any particular time frame for getting a RFE??

The timeframe for RFE is the same timeframe for approval.

The basics are this:

Send in your Form with payment and supporting documents to the Dallas Lockbox

They receive it, make sure you have the bare basics and cash your check, then send your petition to the proper service center (CSC or VSC)

They will receive it and get it in their system

At some point around here, whatever background and security checks are necessary will begin

Then your file sits and waits while all the necessary checks are ran

After all the checks, at some point it gets appointed to an adjudicator who then checks through each portion of the petition to insure that you do indeed qualify.

At this point they will either find that you do and approve you, find that you don't and deny you, or be missing some piece of information and request further evidence.

So, as you can see by this basic timeline above, the RFE will come at whatever time your case would normally be adjudicated.

If you do get an RFE (as I did), be sure to have any possible requirement ready to go and get it back to them quickly. Once they receive it back you should have your decision within a few weeks (Mine took 8 days I've seen as short as 6 and as long as 3 or 4 weeks, but 2 weeks is pretty standard in most cases.

February 11, 2013 - Bank shows check cashed today May 15, 2014 - Interview Schedule Letter (received May 17, 2014) October 6, 2016 - Card Arrived

February 11, 2013 - E-Mail Notification of Case Acceptance and June 5, 2014 - Interview Scheduled at Local office 8:15 a.m.

Thank you so much. So very well explained. One more query related to this. If we receive RFE for this, we need to send the same copies we had scanned & sent..Right?? Or do we have to write fresh letter of intent with current??

If they request original documents from what you sent scanned copies of, you should be fine to just send the originals in, assuming you still have them.

In my case, my fiancee sent me the form signed and original which I sent in, but she forgot to send the letter of intent, so I had her scan it and email it to me and I sent in a copy of that. I got approved without asking for the original, although i've heard of others who've had to supply it.

I had her send me the original so I could send it in if we got an RFE, but it turned out we got an RFE on a totally different matter and we didn't need it after all.

I had no original signatures from my fiancee, and we were approved with no RFEs.

My fiancee has a visa in her passport now.

It's best to get the original documents, of course, but it's possible that you won't receive an RFE.

It's possible they approved me easily because I spent a long time living with my fiancee in her country, as well. I have no idea.

Your mileage may vary.

If I am as lucky as you, it might get processed without asking for RFE.. but you never know. Have to be prepared for anything..

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
