Yeah it is not just one accountant that I have asked in 3 different accountants I am not a US citizen I an just green card holder

I just asked him he told me you can't do that unless u came to US AND THEN get married but I got married before I came to US but after I get the visa

U see what I mean I think that he is 99% right but I will call the NVC and ask them about my case

Well that is completely wrong. If you're married (no matter how or where you married) at the end of the year, you MUST file as married (filing separately or filing jointly). It's not even an option. If you file as "single", that is tax fraud.

In some limited cases you can file as head of household. Also, if you're a nonresident alien (which you're not, having lived in the U.S. for so long), and you're a resident of Canada, Mexico, or South Korea, you might have an exception that allows you to file as single.

thank ypu for your posting

i called the NVC and they told me since you enter US as single and you applied for your wife who is outside the US you have to start your immigration as single ,and once she get to US then you can file together as married and open bank accounts and etc ...

i was sure of that it just i need real people going through the same process but i am still looking for them

any way thank you for you help guys

what they mean by that is : i enter US and in my visa i was single and how in earth can i applied for my wife and my status is single the day i enter US,i applied for my wife 3 months after that and still it was single in my visa and immigration system

it is totaly correct ,the fact that you enter US as single and your date of marriage was befor you enter US ( which is my case) so if i file after that as married and my marraige date was befor putting my first step in the US teritory that they gonna consider it as fraud

i explained that in my first posting but people don't read

any way i want to see real facts from people going through the SAME process

The accountant is right. He cant file married. And get additional deductions . He's not married here. She has no Social Security number. They will most likely bust his ###. And my tax man agrees. The two questions he asked me are. Were you married in America. Does she have a SS number. My wife isn't here. We aren't married in America. And you cant claim you are supporting her as head of household. You have to file single. By default. She shouldn't be on the tax forms at all.

No, this is ABSOLUTELY WRONG. No matter where you are married (you could be married on Mars for all they care), unless you are doing something like polygamy or something, you are considered married and must file as married. Period. It doesn't matter that she has no social security number. If he files as married filing separately, he doesn't need her to have any number; according to the form instructions, he can put NRA if she doesn't have a number. Alternately, they can apply for an ITIN for her if they decide to file as married filign jointly. There is ABSOLUTELY NO WAY they can file as single. Period. This is tax law. This is what the tax forms say.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I am not familiar with the visa lottery but from what you said so far is you can't file as married due to the visa you came over with that stated you were single. Claiming married now would prove you committed fraud when entering the US as you were married and not single? I am asking to make sure, the CO will know this by looking at your visa and your marriage date. The CO will also see that you filed single to keep from reporting that you were actually married when you arrived. You have to provide all the paperwork, they will easily connect the dots. The IRS info provided previously is correct. Should you have entered on a visa that stated you were single when in fact you were married? If the answer is no then the did you commit fraud by doing so? You don't have to answer...

If you gained access legally and your accountant is right (according to you), what's the worry?

Sounds like YOU lied to the US government. Because you came into the USA claiming you were single

You forgot to notify the embassy that you married after you got your visa

You entered the USA as a single man but you were married.

So, you are trying to hide your fraud and one lie builds on another and another

So first you lied to POE when you came into USA as single

Then you lied twice on taxes saying you were single

Now you want to bring your wife over after being married over 2 years and lying 3 times to US government

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

Those saying you need to file as married are definitely right. I researched this on online, through the irs and fafsa (for school) sites. I even called fafsa twice asking if I can file as single because my husband is not in the country and does not have a SSN, and the both reps said NO. If you are legally married, you HAVE TO PUT married and filing separately. Just google search it too. EVERYWHERE says it. Look up married to non-resident alien. No matter where in the world they are, you are married. My father's tax guy told me I should put single, and I refused. I told them what I needed to put and basically how to do their job.. dry.png If you put single, they will ask you, why did you put single if you are married ? The marriage exists regardless.
