Hi,

I had a question about marriage license-certificate application. I am divorced 2 years ago (officially single now) I live in LA California and trying to get married to my boyfriend . I was looking into the application, there are 2 questions which says (number of previous marriage ? and end date?) . someone told me she was in the same situation and she never mentioned and left the answers blank and got her marriage license. I am applying for my boyfriend after this marriage with the USCIS (he is from Germany on work visa) . Can I do the same, just leave it blank I don't want my boyfriend to find out about my previous marriage, Do you all think it is illegal - or they will not issue me my marriage certificate or license? What document would USCIS ask when I apply for him a marriage license or marriage certificate?

That is ILLEGAL.

You MUST disclose it to the state and to USCIS or you will be guilty of material misrepresentation, your fiance will be deported and banned for life. You will also need to give USCIS your divorce decree.

Better pony up and be honest with the person you want to spend the rest of your life with, or you won't be spending much time together at all.

I don't understand why you don't want your boyfriend to find out about your first marriage. Pretty shaky grounds, even before you start an immigration process.

You're messing with his immigration and potentially causing him to face a 10 year (or more) ban from entering the USA for the sake of keeping a secret.

Hi,

So when they ask him at interview about your previous husband (and they sometimes do that just to see if couples disclose things) and he says "Ummm she wasn't married before". Denial trust me.

You have to fill it out. So tell me the person who told you that how did it turn out for them. Did their spouse make it here to US?

I am not trying to lie to the USCIS - Please read my tread, I said ''marriage office'' not application for USCIS . The marriage office is a local city hall office that's nothing to do with Federal level, If I go to the USCIS office they know that I was married anyway we paid taxes to FEDs and State they know I was married, If they ask I can not deny that . I heard USCIS only asks for marriage certificate not marriage license where, is that true?

I just don't want him to find out - and If it don't tell him he will never going to find out.

You understand that you'll have to complete paperwork for USCIS, right? And on that paperwork it will want to know about your previous marriages plus inclusion of divorce decrees? Are you going to lie there as well? Is your boyfriend not going to see any of the paperwork you're going to have to file for him?

If your question is: Can I lie on forms? The answer is "yes" but there are obviously serious repercussions to committing fraud.

please read my subject! I am not trying to lie or deceive any one BUT just my past life THAT I DON'T WANT MY BOYFRIEND TO KNOW, THATS ALL. Its my right I do not want that discussion in my life, if there is an application with USCIS and we go to an interview if they said why didn't you tell him, I simply say - I didn't want him to know that is all and please I don't want to talk about it, Period. so where is the illegal part?

Not telling him is deceiving him. Not telling the state is deceiving them. I believe you need to show your divorce decree in order to let them know you are free to marry. I'm not exactly sure who you think you are not deceiving.

From the accounts I have read, simply not introducing your family to your wife reflects badly into your character or something. I don't know. I'm trying to go through the AOS process myself but my 9 years of dealing with USCIS tells me that you want to give them very little reason to doubt your character or a reason for them to give you a hard time. Because when they see a slight reason, they can make your life a living hell. Because if for some reason either of your have red flags, it will require some explaining and that's a pain the neck. USCIS also seems to have a higher standards of what a bonafide marriage looks like than most other institutions. To me personally, keeping your prior marriage secret is a huge thing to hide from your partner. It will cause trust issues. Of course unless that's not important to you.

You simply don't get it.

First, you can lie by omission. By not declaring that you was previously married and that union was legally dissolved, you will be lying by omission. You sign the document under penalty of perjury. That's why it's illegal.

Second, you must disclose your prior marriage and dissolution as required to petition for your boyfriend. Are you planning in omitting your prior marriage on the petition? If you omit it, then you will commit perjury which is the illegal part.

If you do plan on truthfully disclosing your petition, you do understand that your boyfriend will have access and copies if this for his interview right? He can read right? While this is not illegal, do you want him to find out about your prior marriage by reading his own documents?

Third, you need to show a bona-fide relationship. People tend to regard the disclosure of prior marriages as a sign of a bona-fide relationship.

Do you really think that the US believes you have a real relationship when your fiancé doesn't even know if you have been married or not?

If you want to play games with your love life - then that's your business.

When you fail to disclose the prior marriage on your marriage application, you are committing the crime of perjury.
