Dear all, I need your help

I am getting married with a green card holder next May. So, I would like to know:

1. How is the best and faster way to get green card or even to have the right of living with him in the US?

2. Can I live legally in the US while it is not obtained? If not, Can I go to US with B1/B2 visa and stay there only the allowed as tourist?

3. Should I apply for an imigrant visa now?

4. While I am waiting my process, can i stay with mu husband in the US?

Tks a lot for all tips and recommendations since now

1. The best and faster way to live with him in the U.S depends on how you wanna go about it. You can either file the K-1 Fiance visa or get married and file CR-1

2. K-1 Visa allows you to come to the U.S while is pending but you have to show proof of ties to your native country, and return for visa interview and medical.

3. You can apply either K-1 visa or CR-1

4. You can visit but cannot stay, you have to show proof of ties to your native country. Point of entry has the discretion has the final say in allowing you in the country when you come as a visitor

Tks Canadian for your information, I was really worried about not be allowed to stay in the US while I am waiting to get my imigrant visa.

So, proof of ties can be:

- proof of home ownership?

- proof of bank accounts in Brazil (home town)?

- Return flight ticket (it can have 6 months in between)?

Another point: How long time takes to get K1 Visa?

Since he is not a US citizen yet it will be more time consuming. The best is to get married as soon as possible. Then he can file I-130 for you. This will take time to get approved and long wait for visa to become available. He can not file fiance visa since it's only for US citizens.

He may be able to apply for his citizenship if he has had his Green Card for 5 years. That would speed up the process significantly of bringing spouse to US.

You ask about waiting in US while the process is completed. If you apply for tourist visa you have to disclose that you are married to US citizen and that would mean that you have intent to immigrate. They may deny your visa.

If you want to be with him during this process I would advise not getting married yet and getting some other type of visa (student, employment visa) that would allow you to live here. Then while in US you can get married and adjust status here.

5/08/13 - received biometrics appointment for 5/22

5/09/13 - successful early walk in at Port Chester, NY office

5/22/13 - I-485 updated to Testing & Interview

6/18/13 - EAD went to production

6/21/13 - Card/Document Production for EAD - second email

6/24/13 - EAD mailed

6/26/13 - EAD arrived

7/18/13 - got email about interview

7/20/13 - got hard copy interview letter

08/23/13 - interview - Approved dancin5hr.gif(card production & decision email)

08/28/13 - card production - second email

08/29/13 - card mailed

09/03/13 - card arrived

unfortunately u cant hv all those previlage dear...

- if your husband only LPR, all u can do is wait outside of USA until your GC process done. I've been through this process for more than 2years.

there is no fastest way to get GC, after your husband apply you for F2A category, u have to wait your priority date become current since your husband only LPR and that is about 2-3years.

- if you apply for tourist visa make sure you can shown that you hv strong ties with your home country that u will be back after your visit. but im sure if u mention at the beginning to the consulate that you hv a husband LPR in US, you will get denied!

- yess u should apply for immigrant visa for spouse of LPR soon. bcoz the waiting time is about 2-3years.

once again, unfortunately u cant stay with your husband while waiting your process is done. but u can live in other city that close to your husband place. like I did. my husband lives in NYC, I stay for this pas 2years in TO, Canada. o my husband can visit as much as he want, since LPR US can easily come to Canada.

I hope this info will give u some ideas and not to be discourage.

I undesrtood that I can´t apply for spouse visa and wait with him in the US, can I?

In general, this visa takes 2-3 years to be got. So, Have I to live far away from him during this time?

He lives in the US and he doesn´t want to be back to Brazil soon.

He is GC holder, that means he isn´t a US citizen

The fastest way for you to immigrate to the US is for your husband to file an I-130 to start the spousal visa process. You will need to wait in your country for 2-3 years while the case process.

You can visit the US as long as you are permitted by your visitor visa. However, you will cannot live here. You can only visit.

You cannot file for an immigrant visa at this time. You have no basis to file for one. You can only file when the I-130 Priority Date becomes current in 2-3 years.

You cannot live with your husband in the US. You must wait in your country for the next 2-3 years.

I suggest you to apply tourist visa before you get married. but you must show very strong ties with your current live. that you will be back to your country after visit. and don't ever mention that you hv fiancé in USA, it will make u get denied.

if u hv tourist visa, u can visit your fiancé as much as u can, while you waiting your process done. GoodLuck!

I married my husband he is a green card holder. How long would it take for us to be together. Am not in the US right now. And my B1/B2 will expired In September of this yr. However his green card was expired last November so right now he is in the process of renew his green card by this week. What going to happen now?

This thread was created 4 years ago by claudianut. It is his or her thread. The information given is meant for their situation. By you asking a question related to your own situation you are taking away from claudianut's topic. The moderators will likely close this thread since it is old.

 

You can start you own very easily. Just got back to the forum and click the green "Start new topic" button at the top. You will get a lot more help that way.
