Has anyone had any troubles using a co-sponser? We're petitioning in HCM. The reason I ask is that ive been here with my fiancee since early September, making me technically unemployed, making my credibility look pretty bad if the interviewer asks about my current place of employment. I have another I-134 already filled out by my co-sponcer for Ngan to show to her interviewer, but would it be best to lie to the interviewer and pretend that I'm still in the States working, or should she just come out and say, 'yeah, he's unemployed?' Any thoughts?

Here is why: it's very easy to find out, just pull your SSN with Unemployment Dept in your State of residency, assumped you are receiving unemployment. If he can't pull that on the spot, on the day of the interview, he will delay your fiance's visa approval, longer wait, and if he found out you LIE. You can pretty sure kiss your chance of marrying a vietnamese woman from vietnam for good.

About your situation, the answer would be: It depends! There is NO official statement from the STATE Department or HCMC to say they will deny your case if you have a co-sponsor! They still accept and approve cases with co-sponsors. Prove me wrong people! Questions to you: Are you a professional? Making an annual salary of $50K? Or you're a doctor who just lost his job and is on his way to take another job offer from a bigger hospital? Are you just changing jobs/career path? You're taking a break from job, working from home, working as a consultant, self-employed, or you are just natually wealthy! See how you can spin your situation in a possitive vibe instead of " OH, i'm a bumb, no job, no income, lazy butt" :D

You need to understand one thing: the C.O. does not count on ONE piece of evidence to decide your case. There are folks with solid financial support, two or three co-sponsor with hundreds of thousand dollar incomes/year, still didn't get the visa because their relationship was fake and their case was fraud.

When is your interview? in the next 3 months? You can hope you'll find a job then with a HR Manager who willing to write up an employment letter which states how much you make a year, when you start, with what position etc. Then you're OK.

Or, as I mentioned before, you can be self-employed, doing consulting works etc. Nobody asks you for pay-stubs or letter of employment, they are not THE MUST have evidence, they are one of the many things you should have.

Best co-sponsor: parents! Anyhow, I can totally related to your case, I lost my job two month before I filed my I-129F... long story but Kim is here with me for 1.5 year now... it's a testimony of "HCMC makes its own mind and approves whoever the heck it pleases!" Guideline is fun to have but not always being followed by C.O. and staffs in vietnam.

For now, get your parents to sign off on the co-sponsor, collect evidence and hopefully you'll get a job soon.

In the case of K visas they are Non-Immigrant visas, and anyone can sponsor the person, If your co-sponsor meets the requirement of income sufficient to prevent the Non-Immigrant from becoming a charge of the state from time of entry to Adjustment of status that will be OK. It is recommended to provide an I-134 from you and an I-134 from your co-sponsor, and let the consular officer decide to use one or both affidavits of support.

All they want to see is that someone will be providing support and it dose not need to be the petitioner.

Do not lie, they can and do ask for things like recent 6 months worth of pay stubs, letter from employer ect, and if you are caught in the lie, it will bring into questions everything else in the petition, and the consular officer has the power to deny the petition and send it back to the states.

FYI:

When I petitioned directly in HCMC, I had to:

Go to the Dept of Homeland Security on Le Loi street, and provide written PROOF:

I had been workng the prior year in Vietnam

and also

I had to prove my prior year's residency in Vietnam; therefore, I had to get a police report. Plus, I'm sure they did a background check on me in the US>

This all happened BEFORE, I could apply to petition my wife directly in HCMC ( No K1 visas allowed)

Note: these were the rules, 2 years ago. You've already submitted your petition at the ACS section of HCMC Consulate, just curious?

Well, basically i'm just unemployed. Ive been here in Viet Nam since early September, staying with my fiancee until her interview. I do have my 2003, 2004 and 2005 w-2's from my old work, and I have my mother as my co-sponser, so I guess as long as they will accept a co-sponser, we'll be okay. I just worry that it will look bad since I wont have a job upon our arrival into the States. I'm afraid the CO will integrate Ngan over that. But, from what I gather; if she can say what my plans are when we do arrive, then everthing should move smoothly. Yeah, HCM got packet 3 on November 15th, we're just waiting for her interview date. I call the consulate every monday and friday...haha.

I am having specific problems with their rejection of my joint sponsor (parent). Their attitude with me is that they won't accept any joint-sponsor.

You should not pin your hopes on a joint sponsor. If you have good income in previous years they might consider that. It worked for Matt Stevens.

Talk and PM to STLHCMC, he lived and worked in Vietnam while waiting for his fiancee's interview. Returned to the States without a job. Interview went smoothly!

Bottomline is: will you be able to show them (HCMC) you will have a job and employed when you come back with your fiancee.
