Application for admission withdrawn

I travelled to the US with my husband after our marriage. We were informed that I could travel on my tourist visa ........arrived in the US and was sent back immediately! Had to do the 'application for admission withdrawn' thingy. Have a I 130 and K3 pending currently. My question is whether this will affect my visa application negatively in any way? I have looked up the definition of this term -"an arriving aliens voluntary retraction of an application for admission to the US in lieu of removal hearing before an immigration judge or an expedited removal. Withdrawels are not included in non immigrant admission data" Further more will there be any other docmentation to be completed. I had an return ticket which was just changed, so it was at no cost to the US... :wacko: VERY CONFUSED. Anybody out there who can help?

Infopass appointment to get one year extension stamped into passport 12/14/09 Issued, no problems

Cheque cashed 12/10/09

I797 Notice of action dated 12/09/2009 received 12/16/09

Were you turned back by the POE officer at the airport, in essence never made it out of the airport? Or did you actually enter the country and then get deported by a court?

If you never made it out of the airport, were refused entry by the customs officer and had to fly back home, this will not affect your visa case, it happens all the time, and is one of the risks many take.

Thanx for the reply! Yep I was turned back by the POE officer at the airport :angry: -did not enter the country, did not even see the blue skies!

At least that is one less thing to worry about. Now just the waiting....

If you were turned back for trying to enter as a tourist without being able to demonstrate non-immigrant intent, then don't worry about it. You must disclose it whenever you're asked, but as long as it's disclosed, it won't be a problem. It's a common situation that a lot of people around here have been through. The whole "non immigrant intent" thing isn't an issue for immigrant visas or K visas. Failure to disclose relevant facts is always an issue, of course, so trying to hide a previous problem entering may bring serious problems.

If the reason for being turned back was something more serious than a failure to demonstrate non-immigrant intent (smuggling contraband, for example, or visa fraud), then it might present a problem and you should probably consult with an attorney.

Just wanted to say that I'm so sorry you had to go back! What a pain in the a$$ experience. Hope you get to be back with your hubby soon. I agree with everyone else here in that you shouldn't have any problems with your visa since it happened at the POE. Good luck and I wish you better luck from here on out.

My wife worked in the cruise industry (that's how we originally met) and she ended her contract early to go back home. She was in Alaska at the time but scheduled to disembark several weeks later in Miami. When she tried to leave in the Alaska port the officials denied her. They reason they gave her is a cruise ship employee disembarked the previous week and disappeared. She had to stay on the ship until the next port which was in California. They allowed her to disembark but they had an agent accompany her from the ship to the airport and she had to sit in immigration until it was time for her plane to leave.

Anyway, the point of my post is we made note of this as an attachment with our I-130 and I-129F and they were approved without issue. :thumbs:

My husband phoned the call center before sending in our petitions and 'they' informed him that it was not necessary to send anything or mention this in our petition. So guess we should have know better and been proactive, rather than just believe this.

Yesterday he phoned 'them' to inform them of my change of address and 'they' said that 'they' could not change it because 'they' did not have the papers with them. He then enquired about how much longer before we hear anything and was told that for the 1130 it could take anything from 6 months to a year. He then promptly asked what about the I129f, and was told that that is a fiance visa. hahaha. He continued the conversation and tried to explain that it was indeed a K3 spousal visa, which as we all know is also applied for with the I129f form. So much for getting there quicker.

Needless to say the conversation did not last much longer, and he told me that he is NEVER phoning 'them' again.

So we are nearing the 180 day mark, and my husband will contact his congressman at that time.

Today is one of those days that I keep wondering why, why, why did this happen. I am stuck in limbo and it is killing me. :angry:

hello,

been to the same situation I know how u feel well we just have to wait and see... actually had a couple of touches 3/5 and 3/6 coz i'm waitin right now for my NO2 I'm just kinda worried :wacko: though I know this will not really affect our I129F petition it's just that I'm wonderin if it would have been better if we have included my withdrawal paperwork etc. in our attachments of 129F coz we intend to include it on the follow up forms like DS156 etc. well i'm just wonderin if that was the reason why I had a couple of touches recently and still w/out any change in my application status.

Anyway I'll update you gurl whatevr my case outcome would be since we are almost on the same boat. Good luck to us! :innocent:

I did not receive any of the paperwork, so I have been having nightmares about everything! If I could just get to the approval bit, then I can tackle the next step with new vigour. I am spending far to much time on the internet reading up about all the bad things that have happened to people like us! :crying: And not knowing what effect this will have on our petitions is killing me. I am sooooooooo depressed.
