I need to use a co-sponsor,do the same rules apply as the I-864

Hi everyone. Everything I read about the I-864 says that the person petitioning must be the primary sponsor and that if you dont meet the guidelines you must also have a co-sponsor fill out a I-864 and thats fine!. But when it comes to the I-134 there is no mention of using a co-sponsor in any of the information i have read. I even read on one of the posts that for a K-Visa if the person that petitioned for the Visa doesnt meet the guideline than that person doesnt need to fill out a I-134 affidavit of support. Only someone that meets the guideline needs to fill out the I-134 affidavit of support. I read this from a post that one of the big dogs on here wrote- I dont want to mention names in case I misunderstood what i read but it seemed clear to me what was said. This is the deal- I need to have my Brother be a co-sponsor for me because of a lay off I had. He makes 4 times the poverty guideline but do i still need to send Marie a I-134 with me as the sponsor that she takes to the interview with her or Does she only need a I-134 from my Brother, or do I send her one from both of us just like I would for the I-864

Aug-24-2006 - Back home to the U.S. Again. Leaving this time was by far worse than the last.

Sep-03-2006 - 1 year since Marie and I met online

Sep-05-2006 - I-130 sent to Nebraska - Thanks to the help of the forum our Journey begins

Sep-18-2006 - NOA1 for the I-130 received in mail

Sep-27-2006 - I-129F sent to Chicago

Oct-04-2006 - NOA1 for the I-129F Received in mail

Oct-12-2006 - Email from USCIS - I129F transferred to California Service Center on Oct. 11th

Oct-18-2006 - Email from California saying they received my I-129F for processing

Nov-02-2006 - Email from CRIS(early afternoon) -I129F approved

Nov-02-2006 - Email from CRIS (late at night) - I130 approved

Nov-06-2006 - I129F and I130 NOA2 received in mail-Hooray!!!

In the case of the I-134 this is being used for the Non-Immigrant K-3 visa it shows that they will not become a charge of the state between the time they enter the country and adjust status. Only one I-134 form is needed from someone able to meet the Charge of State requirement, If you are using your brother he can be the solo sponsor and provide for I-134 the K-3 visa interview, but it wont hurt if you both submit an I-134 for the visa interview and let the consular officer choose which Affidavit of support to use, one or both.

This is not the case for I-864, this has to do with support of an immigrant, and the petitioner MUST be the primary sponsor and MUST file I-864, the petitioner can get a co-sponsor to meet the support requirement.

Should he write something like- I intend on giving Marie any support "if needed" for as long as she remains a resident in the United States- is that okay ? If not what would be the correct way to answer this. I seen in the example form that the sponsor writes N/A in that section, but would this be the case because he is not married to the benificiary.

When Dan said "it won't hurt" to submit your own I-134, he meant that you should check with the consulate you're using to make sure it's optional. In Rio, for example, it certainly isn't optional for the future I-864 sponsor (future spouse) to submit an I-134 along with the actual sponsor (future joint sponsor), although technically they shouldn't be allowed to require it. If that wasn't confusing enough...

We wrote what was in the example form for both I-134s. That question was applicable for other visa types but is not really applicable to the K1 situation. Various answers have worked, if I remember.

I dont think the officer will hold it against my wife if she has a I-134 from her husband as well. If he doesnt want it then he just simply wont ask for it. But if he does I think it would be better for her to have it along with her. As for the #11 question- We are allready married and applying for a K-3 Visa-so would N/A also be applicable for a K-3 also, the example form was for a K-1 , and in reality the sponsor(my brother) isnt petitioning for any type of Visa- He is only a sponsor-nothing else. So would N/A be applicable for him also.

I encourage you to check with the consulate. I used a cosponsor in Kiev and was also required to submit the I-134 myself.

In situations where the petitioner does not qualify to sponsor their fiance(e) or spouse for a K visa I generally suggest that the visa applicant be prepared with the petitioner's financial package but withhold it unless it is specifically asked for (in hopes that more people will post the result so we can get more anecdotal evidence on the issue). In your case, the consular section in Manilla has a reputation among VJers for strongly preferring that the petitioner be the sponsor - so strong that many people post in absolute terms 'Manilla does not accept cosponsors'. Based on what I've seen many VJers dealing with Manilla write, I would be surprised if the consular officer does not expect to see your information first and then an alternate sponsor's information only if your's is considered to be inadequate.

For Q11 I suggest checking the 'Yes' box and writing something like, 'Will cover food, housing, clothing, and other living expenses as may be necessary.'
