International travel on K3?

Timeline

Hi,

My wife and I (USC) were married in July '05 and in April '06 she was granted a K3 and we've been living together happily, here in the states, ever since.

We will be going to Brazil during the holidays (for about a month); we have not yet applied for AOS nor AP.

It's my understanding that as a holder of K3, she can travel internationally with no other forms needed.

Can anyone confirm please, is this indeed true?

Tickets booked for travel next week, and now I'm starting to worry...

Can I travel and re-enter the U.S. on my K-3 or K-4 visa?

Aliens present in the United States in a K-3 or K-4 nonimmigrant visa status can travel outside of the United States and return using their K-3/K-4 visa. If they have filed for adjustment of status in the U.S. prior to departure from the U.S. , USCIS will not presume that the departure constitutes abandonment of an adjustment application.

Timeline

K3 is a multi entry visa good for 2 years. No reentry document required unless you plan on staying out of country for an extended period of time. You do need to have AOS pending though.

Thanks for your replies. YuAndDan, I haven't seen anything that said we need to have an AOS pending as you state. What is your source? We do plan on starting the AOS in January, but haven't filed any of the paperwork yet. Are you sure we need to have a "AOS pending" ?

Go by the State Dept website: "If they have filed for adjustment of status in the U.S. prior to departure from the U.S. , USCIS will not presume that the departure constitutes abandonment of an adjustment application". That does not mean you need to have AOS pending.

I'm on a K-3 visa and just got back from a vacation in the Bahamas. The only question asked when I re-entred the USA is if I applied for AOS yet.

Feb. 15/ 07 --- GC approved

Nov. 17/09 -- I-751 sent (Day 1)
