I have heard of instances where NVC approves but the consulate denies based on the earnings on affidavit of support.

The NVC does not approve anything, they only accept documentation, the CO at the Embassy or Consualte always has the final say.

Our journey:

February 11, 2011: Registered for marriage in Wuhan, officially married!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Yea so we really need to make sure this 14,000 is the correct amount for yearly income.

14,000 per anum = 270 usd per week. So if she works the normal 40 hours her hourly rate is 6.7 usd per hour.

Federal minimum wage is 7.25 usd per hour so something is definitely off here?

Well if the sister is all you have just go ahead and at least file your AOS package and get to Case Complete. Who knows the CO might be in a good mood. Since you nor sister have kids they might not be as strict depending on prior years and all. That is the big question 2012, 2011, 2010 what it looks like.

But tell your wife to go ahead and send in both I-864 packages.

So they do not just look at the total worth of the sponsors they look at job history?

Are you sure you aren't looking at how much she has earned so far this year?

You need to get her hourly wage X hours per week worked X 52 (weeks in the year) = annual salary

Unless she is salary.

Also like i asked before what does her 2012 earnings look like. If she was a student and no income thats one things but if she wasn't working or something that can be an issue.

Just food for thought. As i said all you can do is just send it all in and pray you get a real good CO that will be cool.

With no kids in picture they might be more lenient. And I do think you are wrong on that amount.

It baffles me then to see on users profiles the info "NVC approved"

The NVC didn't actually approve anything, they only completed their review of the case (i.e. case complete).

I don't know what you mean "Total worth". It is about your job history dear. And your ability to work and keep work. Cuz bottom line is you are showing the US government you will not be a drain on country resources. That you will be taken care of.

You have to realize these guidelines are poverty guidelines. meaning you are making that you are deemed in impoverished, poor by US standards. So they can be hard or soft its a case by case at times. All you can do is send in and hope for the best.

It is possible for her to get another part time job or find another job that pays her about $10/hr for 40 hrs a week?


And the reason they look at employment history is because it shows the person is a reliable employee with a job history. It's not completely necessary but helpful.

My case is little bit similar. I have raised my topic here in VJ before. VJ members had given me some hope and l am living on it hoping that everything will be fine in interview.

I am a petitioner and have no job rt. now. Previous 3 yrs income is also below P. guidelines. However my co-sponsor's current and previous income is very good almost $60K. So I don't know!!!. Hoping to get my own job by the time of interview if not I don't know in which state of mind the CO will be then..........

But as everyone is saying CO always has a final say and case complete at NVC is just the acceptance not the approval, who knows on a day of interview that stupid' CO comes to take a interview after having fight with his wife and starts uttering ?$@%!$*????^!%@$????#^^@%!%$ ..... ............ I am sure until the interview is happily over, any kind of possibilities will keep hunting me like this.... Good Luck to Everyone and ME/MY WIFE.

Okay not to be preachin but i am. Y0ou need to change that whole attitude because what you speak guess what.

Why not speak approval and a happy satisfied CO who had a good night sleep, a good breakfast and happy will see to your case.

Speak that you are already approved before you even get to embassy. Speak life into your petition not death goodness now.
