K-3 Affidavit of Support-Notorized or not?

Hey everyone-It says in Vj's step by step instructions that both the I-134 and the I-184 AOS need to be notorized but in the instructions that come with the I-184 form there is no indication that it needs to be notorized(unless I over looked it) nor is there a area that a notory public would use to notorize. The I-134 does have a place that the notory public would use to notorize on the form. I also was wondering about which one to use. It seems as though many people are suggesting that I should send both AOS forms to my wife but it again clearly states that the I-184 is to be used for a spouse/K3. Has anyone that has been married and filed for a K-3 actually needed the I-134. I guess I will still probably send both just in case but I was just wondering. . Thanks everyone-Gary

It I-134 used for the K-3 visa interview needs to be motorized, The newest I-864 used by NVC, and AOS interviews dose not. The VJ instructions were written for the previous version of the I-864 forms that used to be notarized.

You send the I-134 to your spouse for the interview, and you send the I-864 to NVC as part of the I-130 process.

About new I-864, I-864A, and I-864EZ, see: http://travel.state.gov/pdf/I-864GenInfo-FAQ-Final.pdf

Thankyou so much YuAndDan, your always a big help :thumbs:Im glad I asked,I thought forsure it was going to be the I-184 that Marie took with her to her interview. So when will I be sending the I-184 to the NVC? Will it be after Marie gets her Visa and comes to the U.S., Do we send the I-184 in when we adjust her status when it gets close to her 2 year mark(90 days prior). Im going to check out the link you sent and see what I can learn from that. Thanks Again-Gary

You mean I-864 not 184. Anyway Here is what is said about the I-130 process.

A few weeks after you have received your last Notice of Action indicating the approval and forwarding of your I-130 application to the NVC, the NVC will send your relative a packet of forms that you and your relative must fill out before your relative can be given an interview date with a consulate abroad. The packet will likely contain an Of-169 form, and an Of-230 part one and two forms that must be filled out by the intending immigrant. An I-864 form is also included that must be filled out by the petitioner (living in the US). The I-864 is the Affidavit of Support form that requires copies of the petitioners past 3 U.S tax returns (or tax transcripts which are free from the IRS) as well as any bank or financial records available (see the I-864 for exact requirements based on your case). The petitioner must make at least 125% above the U.S federal poverty to indicate to the U.S government that the intending immigrant will not become a federal charge to the government when he/she arrives in the U.S.. If the petitioner cannot meet these requirements, then he/she must still file an I-864, and find a joint sponsor who can meet the requirements on his/her own. When a joint sponsor is needed ,proof of their U.S citizenship or permanent residency is required. (i.e. copy of birth certificate, immigration status etc). The joint sponsor must be residing in the U.S, and he/she must also submit his/her past 3 years U.S tax returns along with bank or any other financial records available. The joint sponsor must submit his/her own I-864 form to accompany the petitioner's I-864 form.

Forms that may be either sent back (or requested to be gathered and kept for the interview) to the NVC or the consulate abroad (depending upon which consulate you are going through) before an interview date with a consulate abroad can be scheduled are as follows:

http://www.visajourney.com/forums/index.ph...page=i130guide1

Consider K-3 visa process is actually processing for 2 different visas, K-3, and CR-1 and depending on timing you may be interviewing for K-3 or CR-1 visa at the consulate.

If you interview for K-3, and use the K-3 to enter the country and then do AOS, then you will be sending I-864 in with the I-485 to adjust status.

If you interview for CR-1 visa then you need to have the I-864 at the visa interview, and also have sent a copy to NVC.

Woops-Sorry about that-sometimes I get all these numbers mixed up  Now I understand. Thanks Again YuAndDan- One more question if you dont mind- On the I-134 question # 9 is clear to me but #8,#10 and #11 I need help with(I guess thats 3 questions-Sorry)

On # 8 would include my wife as being dependent on me for support-her only source of income is the money i send her every month. And if so would that be considered wholly or partially dependent because she lives with her parents and that would mean that they support her living arrangments.

#10 asks if I have submitted petitions to the Bureau of Ctizenship and CIS on behalf of the following persons: - Do I put down my wife because of the petitions I filed ? It sounds like i should but question #9 makes me wonder if they mean petitions from a previous case before I filed for Marie-Marie is the first one I ever filed petitions for.

#11 What do I write here? I know I check the intend box but whats a good phrase to use when describing that intention-Do you know?

Well thats it for questions tonight YuAndDan, hoping you can help me again, I would really appreciate it. I am hoping I can get this form finished tonight so I can call my Honey and then hit the sack. . Gosh-we are getting so close in our journey I can almost feel Marie in my arms-I miss her so much. Anyway-Thanks again and God Bless-Gary
