Hi - I'm new to this entire process.

I filed my for a K-1 Visa back in Feb, 2013.

I complete the two sheet and mailed the form off to the Vermont office and included the payment.

I read the form instructions and it never stated exactly what else needed to be included in the petition filing.

After mailing I called the USCIS and they told me not to worry about including any other information that they would let me know exactly what documents they needed once they start reading my case.

It's been 4 months and a letter arrives from USCIS saying:

"if you disagree with the decision and have additional evidence to show the decision is incorrect you may by filing a I-290B, notice of appeal or motion. Enclosed copy. You may include a brief or written statement to support your appeal. You have 33 days to file from this notice. After that the decision is final.

They never say what documents they need? No checklist.

Has anyone out there been approved and know what they want?

I paid $340 and they can't even send me a list of needed documents.

Sorry to hear that, I know what It feels like I lived the same, and after 6 months we recieved the same letter, my fiance made the same mistake when he filed the petition and we decided to hire an attorney so we filed the petition again dry.png and recieved our NOA1 on january 10 , you don't have to hire an attorney there are many couple that have been through the same process with the help of VJ....Good luck with your case good.gif

Try to appeal first, I mean that's 340 US dollars down the drain if u won't try to appeal...just try.

To appeal means you are saying that the denial was incorrect. In this case the denial was valid. The OP did not show proof of having met within the last two years. He did not prove he was a USC and thus eligible for the benefits of the K-1. He and the beneficiary did not include affadavitts that they would marry within 90 days after the beneficiary enters the US. All he sent was a completed I-129F and the payment. He did not even include the G-325A for himself and the beneficiary. No, to appeal is a waste of time and money as the USCIS' decision on this petition is completely correct.

OP: as everyone else has stated, follow the links, read the instructions, read the guides here on VJ and if you have any questions please feel free to ask, but IMHO it would be cheaper and less time for you to refile. Think of this as a $340 lesson and I hope you learn from it.

If you can afford a lawyer, pay the $12,000 and let them worry about all the paperwork . Just make sure they are specialized in immigration law. They will take care of everything , and you get to travel and have worry free fun . Enjoy your journey , and Good luck.

And don't worry about coming back here for more advice. You made a mistake and it's cost you the filing fee. I bought a business 12 months before the biggest economic disaster this world has seen - no use crying over spilt milk oops8rh.gif

There are plenty of people on here who have made mistakes but this site is a fantastic resource full of people who will be only to happy to tell you when you've got something wrong or missed something - and that's a good thing.

So come back here, check your understanding of the process and the documentation and refile - it's not always crystal clear to everyone what any question means on these interminable forms - so ask away....

Of course it is an option, but you don't have to hire a lawyer if you have a straight-forward case (i.e., no red flags). You can do everything yourself as long as you thoroughly read the instructions and make sure you have all the necessary documents complete and well organized. Really, the K1 visa is very feasible without an expensive lawyer.

We did the same, she cost $1500, did a decent job, but after finding VJ we realized we could have done it without her.

This is a place to ask questions and to share a common ground, not tear a person down. I understand that you were trying to provide information, but there is absolutely no need for your comment. We are all in this together, this at times can be extremely trying; there is no reason to make a person feel worse.

I'm quite sure I've been around here long enough to determine what this place is for.

It is sometimes and sadly necessary to correct a careless filer with an e-smack.

In this case the "petition", such as it was, was so carelessly prepared and so carelessly filed that it became nothing but a clog in the flow of processing real petitions that are carefully put together by responsible filers.

Those of us who have long since completed this process are here to help responsible, conscientious couples execute their journey in the quickest and most painless way possible. The OP needed a small wake up and he got one. Save your comments for incorrect information, such as information implying that using an attorney is somehow quicker or better than taking ownership of your own case and seeing it through.

Even with all that you have said I agree that this site is here to help but there are a lot of unkind, unnecessary comments that people make. I am in a position now to help and instruct. In my family most of the members have been through this process. Nothing new to me some worked others did not but even in correcting others there is a decent way of talking to people that is a blessing or a curse. Words hurt even if the individual is making unintelligent decisions. We still need to be cautious of the words that come from our lips.

I'm pretty sure the OP knows that they incorrectly filed without your 'e-smack' based on the numerous posts explaining how to correctly refile.

I'm not defending the OP's actions, but there is no need to insult someone's intelligence. That was the point I was making.

And instead of claiming that I am providing incorrect information (of my post about having an attorney), maybe you should have read what I wrote. I never implied that having an attorney would speed up the process or make it easier, I actually said that because we were able to hire them in stages; I was happy that we would not be forced to continue with an attorney. I don't think having an attorney is needed, we thought it would be a good decision for us at the time as there were other circumstances at the time. If I had to start over, I would not have hired an attorney. I only wish we would have found vj first.

Just finished getting all my paperwork toghther for the I-129F, and am going to mail it tomarrow. It barely fit in the envolope was over 2 inches thick and it has to wiegh 2-3 pounds. I can't wait to see what the post office wants to mail it. LOL. If you follow all the instuctions you find here there is more than enough information on what to send.
