In my opinion, you don't need a lawyer. Just follow the instructions for what is required (as others have said). Visa Journey has great guides and examples of how to word things. Appealing will just be a waste of time because USCIS was forced to reject your petition based on a lack of supporting evidence. This is the first step in a long process that will require you to complete many forms and provide many documents. It was helpful for me to complete a cover letter that listed the contents of my package and then check that list against the list in the instructions and the guides on VJ. Once the forms are filled in and all documentation completed, triple check that you have not missed any boxes or signatures. Good luck with your journey! smile.png

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!

I used the Step-by-Step Guide on How to File for a K-1 Visa for your Foreign Fiance(e), following the Assembling the I-129F Package: Checklist section almost exactly as listed. Items 1-11 of the 14 are relevant for all I-129F petitions, so completing them all and assembling in that order is what I did. I didn't bother "front-loading" my package with a lot of evidence either; just 1 page of pictures printed on regular paper and copies of plane tickets, hotel receipts, etc. from my prior visit. I think my entire package was less than 15 pages.

I got some assistance before filing from my local catholic charity, this is the checklist they provided me

birth certificate of the petitioner (the US citizen)

US passport (i photocopied the entire thing, every page)

birth certificate of the fiance (translated into english if not already)

divorce decree or death certificate if prior spouse (for both the US citizen and the foreign fiance) translated into english of course

2 passport photos from petitioner and fiance

statement from the petitioner of the circumstances how he/she met the fiance (your love story) mine was 4 pages long

evidence of the relationship - photos, cards, phone bills, cards, mail, change of rings etc. exchanged during the last two years

G-325 form filled out and signed by petitioner and fiance, one form for each, must be original ink signature, no copies

and the fee of $340.00

we are currently in the adjustment of status process and other than a little advice from catholic charities and reading the VJ board, and searching on google, I have done all paperwork myself, a lawyer is not needed if you read it once, read it again, collect everything, be ####### and triple check yourself, you will be fine

And don't worry about coming back here for more advice. You made a mistake and it's cost you the filing fee. I bought a business 12 months before the biggest economic disaster this world has seen - no use crying over spilt milk oops8rh.gif

There are plenty of people on here who have made mistakes but this site is a fantastic resource full of people who will be only to happy to tell you when you've got something wrong or missed something - and that's a good thing.

So come back here, check your understanding of the process and the documentation and refile - it's not always crystal clear to everyone what any question means on these interminable forms - so ask away....

Hi , I just wanted to add,

If you can afford a lawyer, pay the $12,000 and let them worry about all the paperwork . Just make sure they are specialized in immigration law. They will take care of everything , and you get to travel and have worry free fun . Enjoy your journey , and Good luck.

All the required documents are in the instructions in black and white. Don't try to say they aren't there, because they are as plain as day.

Did you send only the fee and the I-129F and nothing else? Then they denied your petition for sending such an incomplete package.

You can refile.

No documents listed? LOL. Can you read? The instructions are pretty clear and not necessarily geared towards the brightest crayons in the box.

From the instructions:

3A Submit a copy, front and back, of your US birth certificate (OR) 3D submit a copy of your unexpired US passport

5A Provide evidence that you and your fiance have met in person at least once over the last (2) years.

5B Provide original statements from you and your fiance that you intend to marry within 90 days of his/her admission to the US.

6A Submit a completed and signed G-325A form for you and your fiance

6B Submit passport-style photos (recent) of you and your fiance with names on the back

6C Submit evidence of any other names used by you or your fiance

7A Submit certified copies of all police/court records on all listed charges, mostly related to domestic violence

Best to re-file. Better luck next time.

Search about front loading the petition. It will be a good primer even if you don't front load. But I think front loading is a smart thing to do as long as you don't go overboard.

Too bad about the $340 but consider it a good lesson that will make you have razor focus going forward.

You have lost your first petition and fee. You will need to file a new one. Most people here do it by following the K1 guide under guides. It is pretty good and you can come back and ask questions. IF you decide to lawyer up beware some charge high fees and are no good, Some charge low fees and are very good. There seem to be more bad ones than good ones. They tend to take your money , only half fill out the paperwork and not respond to your calls.

If you file again remember to tick off that you have a previous K1 petition it usually isn't covered in the guide because most are first timers.

This will not be over quickly. You will not enjoy this.
