Visitor Visa while I-130 is pending

I have a question guys.. I submitted an i-130 and i-129f for my wife back in January. I was wondering if she would be able to visit me with a tourist visa while the other applications are pending?

Also if she was able to visit me what happens if she is approved while she is visiting. Does she have to go back immediately for the interview or can she schedule her interview date. We fear that if she comes and visits and after a week she gets approved she would have to go back right away for her interview, thus making it sort of a waste of money. Is the interview date chosen for you or can you schedule it and push it back like 4 months. We don't want to purchase a ticket to visit and then she can only stay for like a couple weeks. Does that make sense ?

Yes she can apply for a visitor Visa while petition is processing doesn't effect it at all. She just has to show strong ties to her country.

She does have to go back for interview that is true though.

But interview in a week what do you mean. After you finish at USCIS and get approved you will then go to NVC which is a best another 2 months of processing. (I would go here to NVC filers thread read post #1 and #2 to read up what is next stage).

After you get case complete than you wait for interview date which is about another 2 to 3 months depending how busy your embassy is.

Timeline

The chances of her getting a visitors visas aren't great, showing strong ties is harder when you have a spouse in the US. Because you will receive notice when the petition is approved stateside you should have time to get back and do your medicals and get police certificates in order before the interview.

This will not be over quickly. You will not enjoy this.

She can apply but her chances as very small that she would be approved with a pending petition and USC husband. I was told they would never grant the visa and that even if they did I would be turned away at the POE when they saw the pending petition.

The thinking is that the ties are to the USC husband upon entry. However she will not know unless she tries. So its a matter of money and effort to prove beyond doubt she must return.

Exactly how long were you planning on her staying?

You applied in January, so standard processing time would indicate you should be approved very soon.

So then lets say you move to NVC very soon and you're interview is maybe in like 3 months max from now.

I'm just throwing out some possible numbers here.

So how long does it take to get a visitors visa?

I assume you dont just get one over night right?

A quick google search says between 3 and 6 weeks so, that's a whole month gone just waiting.

Anyways, if you intended for her to be here for more than a few weeks at the most, her ties to her country are probably not even very strong.

If you wanted to make a visit like this, it probably should have been started months ago.

You're over half way through the process.

Best to just finish waiting it out and save your money.

Go visit her?
