hey guys , if someone hold a visitor visa to U.S (b1-b2) can he apply for a Green Card ?

No.

* I-130/CR-1 visa by Direct Consular Filing in London
3rd May 2013 - Married in London
7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)

* Naturalisation (Citizenship) via Phoenix Lockbox

No - you cannot. Just because you land in the US does not mean you qualify for a green card. You must return home to Tunisia when the time is up, just like your dad did if you want to be able to come back to the US again.


Because a B1/2 is a visitor visa. For visitors. Not immigrants.

A visitor/tourist visa is a NON Immigrant visa only.

We've gone through this before. Re-read your own thread. Your brother is your only current means, and it'll take 12 years.

You currently have no other options, as you have no other USC family, nor a US job with a sponsor willing to support you.

You CANNOT stay. You can continue to visit on your visitors visa, but you CANNOT stay past the time given- usually 6 months- and you cannot work on your tourist visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
