I got approved today for my I-130, in the hard copy letter they have sent I-797 and said that we need to sent the I-824.. isn't the I-797 for adjustment of status?

but they are acting as i'm in the country already this i'm not

understand.. why do we have to send a i-824 if i'm already approved..

someone help me to understand this at all.. did they made a mistake sending this to us

Looking at this website: http://kb.immigrationdirect.com/Knowledgebase/What-is-the-purpose-of-Form-I824 I would say that number 5 probably applies to you and they thought you were in the USA and you weren't. Sending the form would ensure that the approved I-130 actually goes to the NVC so you can finish the process. Either that or have the petitioner contact the USCIS, talk to an ISO (tier 2) and try to get everything straightened out.

*** moved to process and procedures as topic is also about a complication during procedure not just a status update. ***

I had a similar problem with the wording in the approval notice.

I knew I had an issue with how I filled in Q22 in the I-130.

So, numerous service requests prior to approval about this were useless.

Infopass appointments about this were useless - even I asked the humans to make certain it was going to go to NVC and not NRC - they promised me it'd go to NVC.

In the end, it took an Immigration Liason staffer with my congressman's office to sort this out and get the casefile headed over to NVC.

I suggest you contact the ILS human soonish, set up the release letter, and write up a letter stating that the I-130 got pegged incorrectly to go to NRC and that it should go over to NVC instead.

Good Luck !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
