RFE - Worth getting transcripts?

Hi there,

Yesterday we received an RFE for our ROC. We've already sent them copies of our taxes filed through TurboTax. Is it worth requesting tax transcripts from the IRS?

We've already sent in:

  • Copies of the passport and green card of Phel
  • A partial copy of our 2011 joint federal and state tax return.
  • Copy of 401K enrollment confirmation of Phel designating Mr. Phel as the beneficiary.
  • Copy of car insurance in both our names.
  • Copy of our Visa cards showing a joint account.
  • Copy of our American Express cards showing a joint account.
  • Copy of our health insurance plan summary showing a joint policy.
  • Copy of our joint vehicle financing contract

We're going to send in leases (don't know why we forgot these the first time), photos, old home insurance, letters, trip itineraries, cards, old car title, car payments and affidavits (is it better to have these notarized?)

We're both authorized users on each other's credit cards, but we don't have a joint account. What else could they want?

Hello phel,

I think you might also want to include joint bank statements that are showing a 2 year span of activity. Since you do not have a joint bank account, include the statements of the credit cards in which you are an authorized user. Sending just a front copy of the cards is not enough, it is important to show the financial activity. Do you have utilities that show both of your names on it, or a cell phone family plan?

We sent the Turbo version as RFE and our case was approved within 10 days.

Reading the forum, it seems people prefer the official transcript.

If you slready send the Turbo version out, no need to send the transcript as additional documentation. USCIS does not like to receive docs multiple time or the ones sent without their request.

Our credit card statements don't show who made the purchase, just the purchases and amounts. Unfortunately. Had we known that we would have made everything joint.

Most of the utilities are in his name but I pay them. Cell phone plan is in my name only since I get a discounted rate through my employer.

You only sent a partial copy of your 2011 taxes and not a copy of the entire return? I would include tax return transcripts for 2011 and 2012. Also, your timeline says you married in 2010, so 2010 taxes too? They are free and easy to get from the IRS,

I know you can get tax return transcripts for free (Federal Taxes), but what about transcripts of State Taxes? Is there a phone number I could call to request them? I live in California.

Ah! The OP asked if affidavits had to be notarized. I thought they didn´t need to. So, am I wrong?

I believe it doesn't matter who made the purchases. What matters is the account activity. Also, send 2 years of utility bills on his name, and send two years of cell phone bills that show both numbers on your name. As an option you could highlight the payment method on the bills, so it shows the ending of your authorized credit card or your debit card. It is important to demonstrate that you have commingled finances. All the bills, no matter whose name they show should have the same address where both of you reside.

Did you send in a copy of your and your spouse's licenses or state ID's? If not, definitely include those. It is worth getting a tax transcript, I suggest sending in copies of any W-2's you might have.

Any copies of tickets from trips you've made and send in more bank/credit card statements, maybe one from every quarter if not all two years worth.

Think of any bills, doesn't matter what, as long as it shows you live together and are comingling. We have a family cell plan, although not in either of our names, I made sure to send copies of them that go back over a year and highlight our numbers on each of the bills.

We got our affidavits notrarized but it is not a requirement.

  • Copies of rental leases for current and past residences
  • Copies of gas bills for past and current residences
  • Copies of phone bills

Financial Records

  • Copies of 2011 and 2012 tax returns
  • Copies of home insurance policies in both names
  • Copies of car insurance policy in both names
  • Copies of car loan payment history and corresponding debits from Mrs. XXX's checking account along with car insurance payments

Birth Certificate

  • We do not have children

Other Evidence of Bona-Fide Marriage

  • Photos
  • Travel itineraries

Come on approval!!!
