You will NOT be sent any reminder to file this petition from USCIS. Per the USCIS,

"At the time you obtain conditional resident status through admission to the United States with an immigrant visa or through adjustment of status, the USCIS will notify you of the conditional basis of your status, the requirements for removal of the conditions and what will happen if you fail to file a petition to remove the conditions.

The USCIS does not send a second reminder to conditional residents to petition for removal of conditions. During the 90 days before the second anniversary of the date you obtained conditional resident status you and your spouse (if still married) must file to remove the condition."

This appears to have changed!! Just got a letter from USCIS today, "Notice of Requirement To File Joint Petition To Remove The Conditional Basis Of An Alien's Permanent Resident Status", saying...

"The records of this Service indicate that you entered the United States as a conditional permanent resident on 10/06/2011. In accordance with Section 216 of the Immigration and Nationality Act you must file Form I-751, Petition to Remove Conditions on Residence. Failure to do so may result in the automatic termination of your Status. You can obtain Form I-751, as well as filing information and fees, from www.uscis.gov or call 1-800-375-5283."

It's not wrong.

If you look at the law, it says that they might send you a courtesy reminder, but that if a reminder is not received that it doesn't absolve you of the requirement to file to remove conditions.

It's optional, and people should be prepared to file whether or not they get the notice.

Agree with what Harpa said, even if it was 'wrong' VJ is helping people be proactive and not depend on USCIS - the fact that you got the letter has NO impact on the effectiveness of the guide. After all, its not the official guide so I am not sure what your are asking here.

Pretty much the worst thing you can do is rely on the gov't to remind you of ANYTHING in this process.

It should be expected that you'll get no reminder on anything.

And if you do? Lucky you.

Pat yourself on the back and consider yourself one of the special ones.

This is not the first topic about this.

You MIGHT get it. I personally got one, as did many other people, addressed to my previous address (the one I got my GC sent to). I only received the letter because I had my mail held at the post office and I personally know our post-master.

The address for the reminder is not updated when you send an AR-11, this indicates that its not important because if it WERE, the address would be updated with the other info.

As others said, doesn't matter whether you get it or not. it is up to YOU to remember when your window opens and your GC expires.

It's clearly wrong. "will NOT" and "does not" both indicate that the chances of getting a reminder letter are exactly zero, which is plainly false. Both of these errors can be easily corrected simply by substituting "may or may not".

who cares? Some get it while the others don't

Do you rather have this "wrong" instruction setting up somthing to alarm/remind by yourself than 100% relying and waiting for the letter then miss the deadline because USCIS somehow forgets to send you one?

During our AOS interview, the IO told my husband you have to remove conditions by such and such a date. He told us it was our responsibility to take care of ROC. When we got home that day, we wrote the date down and started collecting evidence right away. We actually did get a letter reminding us, but we were not expecting anything and with our without a letter, we knew what we had to do.

Stop being belligerent Ivriesling! You could go about this a different way suggesting the change of wording rather than complaining it's wrong. The VJ forums/community do offer a great service that's voluntary.

I remember reading of 3 horror stories here

where

the green card holder moved, even notified USCIS,

but the notice was sent out to the last stored address

and since the letter nix'd back? Their official status in the USA was almost terminated due to failure to notify USCIS.

It's a mess, you betcha, this notification letter.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Your wife will not remind you of your anniversary. You must remember ( or be in big poop). The government may not remind you to do ROC. You must remember ( or be in even bigger poop). Notifications or not, it is your responsibility.

hmmmmmm which is better, being prepared NOT to get a reminder, but getting a reminder anyway....or expecting a reminder, then not getting one and having your status revoked?

Personally I'd recommend NOT expecting the reminder and consider it an extra bit of luck if you do get one, but to each his own.
