Hello all,

First I would like t thank the wonderful people on this website that take the time to respond to our questions!

I do apologize if I haven't post this at the right place.

I married and international student (overstayed) and we are about to file different documents.

We are not sure what to write for some of the questions:

---For example on the form I-130 they are asking on question 14: Date authorized stay expired, or will expire, as shown on Form I-94 or I-95 ( we looked everywhere but couldn't see an expiration date on the I-94, and we were wondering if it is the date given on the I-20 that we should use?) Any ideas?

----We are planning to go visit her family this december (big family) and I was wondering, when we do file for the I-131 where they ask for the different countries we are planning to visit (her family is all over brazil, switzerland, France, England, China, Nigeria and we are hoping to visit at least 4 or more of the country listed ) What should we put down? Continents? or A list of all the countries (Not enough room) (the trip will be our honey moon offered by her family member with stop each) ????

----Form I-485 what should we put for : Current USCIS Status (Student overstay for 4 years now)???, and after that there is a question about the USCIS status expiration? What should we put?? Where to get the information, without putting her into trouble?

----Form I-765 answer to questions 16? we put c9, is that correct?

Thank you in advance for your answers, sorry for the long mail!!

I cannot really help you with your specific questions but you DO NOT want to travel until her green card is in hand. She has an overstay of 4 years?!?!? She needs to remain in the US until her green card. Some have been denied entry, even with an approved advanced parole travel document, and then the process becomes much harder

good luck

PS - you might want to post this in the adjustment of status seciton

The expiration date on your I-94 is almost certainly "D/S". That's what you should put on the form.

That is on a part of the form that you're not supposed to fill out for advance parole. See that right after Part 3, question 3, it says for Advance Parole skip to Part 7.

"F-1", or "F-1 out-of-status"

----Form I-765 answer to questions 16? we put c9, is that correct?

yes

This is not true. An F-1 admitted for D/S basically cannot accrue unlawful presence for the purposes of the bar, unless an immigration judge rules against them or something.

Although you are correct, if it was your wife would you risk it?

I wouldn't
