Hello friends,

I have run into a question about filing the EAD (work authorization) along with the AOS. The EAD filing instructions state the following about filing the two together at the same time and the processing fee that goes with them:

"If you filed Form I-485, Application to Register

Permanent Residence or Adjust Status, as of July 30, 2007, no
fee is required to also file a request for employment
authorization on Form I-765. You may file the I-765
concurrently with your I-485, or you may submit the I-765 at a
later date. If you file Form I-765 separately, you must also
submit a copy of your Form I-797C, Notice of Action, receipt
as evidence of the filing of Form I-485 as of July 30, 2007."
This information was updated in 2011, so I wanted to be sure it was still accurate prior to sending all of the documents without the fee for the EAD as I am sending it together with the AOS and the fee for that. I have searched the USCIS website but have found no other information so I am searching here as well. Thanks for any additional information! :)

Correct. You should also apply for AP (form I-131) because the fee is waived for that as well. It will permit you to re-enter the country if you need to leave during the process for some reason. The form is simple and the attachments are the same as with AOS so you just add the extra copies to go with the form.

Total for AOS+EAD+AP is $1,070, same as if you file for AOS only. And you mail all 3 applications in the same envelope to the Chicago lockbox.

Total for AOS+EAD+AP is $1,070, same as if you file for AOS only. And you mail all 3 applications in the same envelope to the Chicago lockbox.

So, the additional $85 for biometrics should be sent WITH the AOS fee at the same time? I was unclear about if we need to take that fee to actual biometrics appointment or not. Thanks so much for your help!

Yes, it's $985 + $85 for biometrics, so total is $1070 that you write on one check and mail with your AOS (+EAD+AP) application(s). You don't bring any money to your biometrics appointment. Just yourself, the biometrics appointment letter and an ID (if name not matching the one on the letter, bring your marriage certificate as proof of a name change).
