Yeah, my question is should we still use the EZ form in this situation? In any case we'll have a co-sponsor since our tax return for 2005 was below the poverty guidelines.

The I-864EZ form is used for simple cases. If you are going to use a co-sponsor you have to use the I-864, and you co-sponsor uses an I-864A if they are in the same household as you, or I-864 if not in the same household.

Dan,

Point of clarification. The I-864A is not used for joint sponsors. It is completed by both the sponsor and a household member whos income is being used on the sponsors I-864. In this case there is no joint sponsor as such. A joint sponsor uses his own I-864.

Aussie-

I am using my Mom as my co/joint sponsor. We have the same address. Does she use the 864 or 864A?

Thanks a ton!

(She filled out the 864 alreasdy but if we switch to the I-864A, great!

If your Mom is a household member as you indicate by same address, you can use the I-864A and use her income on your I-864 to meet the poverty guidelines. As I said, you both then complete the I-864A as it is a Contract Between Household Member and Sponsor.

From USCIS....

By signing this form, a household member who is not a sponsored immigrant, agrees to make his or her income and/or assets available to the sponsor to help support the immigrant for whom the sponsor has filed an affidavit of support.

Have a read of the instructions that come with the I-864A.
