Hi, I have questions in regards to what my wife and I need to do next. She came here from Ukraine in December and we were married in February. Since then we filed for adjustment of status and she was fingerprinted in March. Someone told me that we would get her green card within a couple of weeks. We had not heard anything so I called about a week ago and they said that they are currently approving cases from September and we filed in March. In the mean time she got turned down for a social security # because her visa is expired and she does not have a green card. Is this a normal situation or am I just talking to the wrong people about her ss#? The social security office here told me that maybe we can get her a federal tax id # quicker because I was expressing concerns over our need to get her health insurance. Does anyone know if the tax id # will suffice for her to do things like getting her health insurance and/or a drivers license? I could probably have her tax id# on the way in about 6 weeks because it sounds like her green card is at least 6 months away.

Currently I have her insured with a visitors health insurance which is meant for people visiting the US. She has been here over 6 months and the 6 month policy I got her will expire in a couple of weeks. Any help is appreciated, thank you!

If her I-94 is expired than she won't be able to obtain a social security number until she has either an EAD or her green card.

You filled for an EAD with the AOS package correct?

SS number is out for now as said above BUT you can get one once the EAD is in hand which almost ALWAYS within 90 days from them accepting the package (filing date on NOA1). watch that case number on the USCIS site.

You can add her to your insurance and should not need a soc. give them a copy of your marriage lic and let them know she is not a US citizen. It is a common exception for health insurance. If that fails then you are close to a SS number based on EAD anyway.

DEPENDING ON YOUR STATE, she should MIGHT be able to get a drivers license with her AOS 485 NOA1 letter. Check the DMV in your state for specifics on non US citizen requirements.

Actually I am kicking myself now but I did not include her travel or work documents ( I forget the numbers of the forms.) I was on the phone with ISCIS at the time and they said that I did not have to include them and could send them in later. I can mail them out tomorrow, I didnt realize it would affect her being able to get a ss#. Is it too late to send the forms in?

Yes, you can file the I-765 and I-131 now and still have the fees waived. Just be sure to include a copy of the NOA receipt notice from filing the I-485.

Your wife can get on your insurance without a SSN. AOS can take a year.
