Tired of waiting sent 129F for K3

I filed an I-130 in Sepetember 2012 and have not recieved NOA2 so today I sent in paperwork for for a K3 visa I know will probaly be obesolete and I-130 will probaly approve anyday now but want to cover my bases have to do something this waiting is kiling me.

No one does the K3 anymore because it's never faster than the CR-1/IR-1. It's considered obsolete.

Was transfered to Dallas Tx I've had info pass and congressman enquiry twice I see a lot of people that filed after me have NOA2 already just doesn't make since why so long

Yeah I was hopeful that infopass would have given me more but they just won't nail down when things would happen all they said was case is close to be assingned to an officer but still no news

No disrespect with the experts here but i will just share based on my OWN experience..

PD Is September 2011. After 7 months without hearing from USCIS, we contacted Congressmen, Senator, Infopass, Ombudsman which are all No Help..After months of waiting from USCIS, we sent the I129f together with the NOA1 of the I130 on November 2012..Feb. 14, 2013, we received RFE for the I130 and just a days after another RFE for the I129f. Now, this is just MY opinion: that maybe what triggers moving on with my I130 is because when they received my I129f with the NOA1 of the I130, they saw and realized that it was pending for so long so that's why they dig in our I130..The reason why i think like this is because USCIS wont give us e,act answers what is causing the delay..

With regards to NVC, because it was both approved, they sent us a notice that says:

"This letter is to inform you that National Visa Center (NVC) has concurrently received both an approved I129f petition (for K3 nonimmigrant visa application) and an approved I130 immigrant visa petition (for a CR/IR immigrant visa application) filed in behalf of your spouse.

The Immigration and Nationality Act only provides for the K3 classification for spouses of US citizens who are awaiting approval of an I130 immigrant visa petition or the availability of an Immigrant visa. Since your I130 immigrant visa petition has been approved and an immediate relative visa is available, it appears that your spouse may no longer qualify to be issued a K3 visa. The National Visa Center will send both approved petitions to the consular post where the adjudication will be made. This letter is just to give you notice as early as possible that U.S. immigration law requires processing under the immigration visa and not the K3 visa."

So you can send an I129f to go for a K3 route but it will not succeed at NVC..

Thanks that makes me feel better I'm hoping it will trigger a movement also so many people on here have NOA2 in a coulple months i'm coming up on 9 months

I applied for I130 back in Feb and got my NOA1 after couple of weeks. People advised me to file for K3 as well for number of reasons 1- it will expedite the process 2- its free 3- it doesnt hurt caz if the I130 is approved first then K3 will be discarded. So I did file for K3 in March. NOA1 was the last notification I received from USCIS - I called my congressman, senator, USCIS customer service and tried to check online for the status update but had no luck (my receipt number was MSC and USCIS doesnt update MSC numbers for some reason) Today I got an appointment for a local office and met with an officer. I was told that my case was on hold because my spouse already has an alien number. Upon further investigation we found out that K3 application assigned her with an alien number already and caused delay in the I130 process otherwise it would have been approved by now.

so my advice to everybody who is thinking about going the K3 route ..... DONT !!! Just file I130 and wait for it. Dont confuse them - they are simple ppl and get confused very EASILY.

Called sure enough when I called it was messed up they put me down as beneficary so got that fixed gone in on the 12th for infopass wish me luck

To offer up a different viewpoint on this... For many, the k3 actually slowed down the cr1 ... This is because the cr1 application was pulled out of queue to allow for the k3 application to catch up with it and for them to be joined it.... It has happen to several VJ members... But I hope for your case, it triggers someone to pull the file and adjucate....

Thanks when I called they swore it would not slow down the I130 process I read that after I submitted and scared me also thanks for the good wishes
